This exactly. When we took over the management of the HOA property management in the rental properties, people were being fined monthly for changing out rotted old wood windows. No shit. The windows were so old, the wood was rotted out and most of the windows had huge gaps.

The HOA would not approve any windows other that the old original style. This company was out of business and no other company made these style windows. Some property owners just replaced the windows anyway with high energy efficient ones that looked great. These owners were fined monthly. Some had liens on their property for almost the value of said property (if I remember, one was over 50,000).

My BIL lives not ten minutes from us in a really nice area, but has an HOA. He has been fined several times in the past 6 years for stupid shit like a dead flower in the front yard. He has that one framed on the wall. 50.00 for having one dead flower. Good Lord. I wouldn’t last in that area.

Yes, I would keep looking. I don't even work on my own cars that much anymore but that's an HOA going way too far IMO.

Actually, that's exactly what they can do in Texas, I'm not sure about other states. An HOA can simply claim that they sent you a couple of letters (no proof that the letters were mailed is required), tack on some fines, file a lein on your house, foreclose, and show up with the Sheriff to escort you out.

HOA's are nothing but places for little Hitlers to gain power over others. I wouldn't consider a house in an HOA area, and I'd fire any real estate agent that even suggested showing me a home in one.

I was fined 500 for changing my oil because it was a repair.
I fought it because it isnt a repair.

I moved out 3 months later.

I would pass on that because I like tinkering and they may consider it repair.

As long as I’m not working on them out in the street they don’t care. I like not having junk all around me from neighbors. I grew up with my dad collecting stuff like that so living in a HOA is a breath of fresh air for me.

Right, I would appreciate the tidiness of the neighborhood. That stuff I like. What (legal stuff) happens in my garage shouldn't be against the rules though. Makes me wonder where and why they draw the line. If they said no storing excessive fuel, no meth labs, no crack cocaine operation with a bunch of girls in underwear bagging it up, no unsafe accumulation of shit, that's fine.

I would not buy anywhere with an active HOA (current board; monthly fees) but I (YOU) especially w/should avoid it because repairing, building, and tinkering with vehicles is one of your best-loved pastimes! Think of all the reasons you've wanted to live in "your own" HOUSE!! All those dreams and concentrated plans that got you to this point included visions of car repair in the garage... and the driveway. You're gonna wanta have us around, everyone holding a beer, and showing us the current progress on each of your creations, some of which will be in the driveway. :)

Now I've made it through page one, and it looks like you've figured it out already:
Now I can sit back and enjoy the Show. FWIW, if all of (y)our screwy forum friends can get this thread locked..., well, that'd be good illustration of what you could expect if you accept HOA oversight.

Yeah @Sunnier you're right. I'm gonna break the news to the realtor today and keep looking. I might be out a few thousand on the good faith deposit but lesson learned. I'm steering my wife back to a neighborhood with no HOA and RV parking on the side. I don't want an RV but that's a good spot for a project car.

while HOA's do have their good, your dues usually pay for pools, clubhouses, sometimes golf courses, tennis courts, that are exclusive to your community. The HOA I lived in had a lake that you could go and borrow a community boat and cruise around the lake, and it was all included in the HOA fees. But the downside is a community look and feel that you have to be ok with, and sometimes squabbles with neighborhoods and the association.

Theres one entire city close o where I live called Canyon Lake. the ENTIRE city is a gated community with a "POA" or property owners association, but their dues offer all kinds of things, from exclusive use of a giant lake, all the way to horse corrals. But knowing a lot of people who live there, the POA can be a real treat sometimes. In the entire city, your not even allowed to ride a motorcycle. You have to park it at a motorcycle lot near the gates and drive your car to your house. If you want to bring your motorcycle home, you have to trailer it. that place is run by old lady nazis....

Good Luck. Also, don't trust the agent to tell you the truth about the HOA. Some friends bought a house a few years ago and were assured there was no HOA. The bill for the dues was in their mailbox shortly after they moved in. They lived there a couple of years, sold out, and moved to a non-HOA neighborhood.

Can I just point out that I've noticed a difference in HOA's based on the state. I've heard nothing but horror stories in places like CA. My neighborhood here in TN has an HOA and it's fine. It costs only $70 for the year which helps pay for the street lights and some landscaping. The only thing they ask us not to do is blow our grass clippings out into the road. Beyond that leave us all alone.

It really depends on the area you live in. If you are likely to live around a bunch of shit bags they seem to be a lot more strict.

Gurantee that $1000-2000 is worth not having to deal with the pain of some short power hungry dictator wannabe with a donut showing up on your doorstep with a smug look on his face while he tells you to do something HE wants you to do with YOUR property.

@proROB I know Canyon Lake well. I used to hate taking service calls there because the guards would make me wait at the gate until the home owner verified that I'm allowed in. This particular community I looked at I though would be okay since fee was only 70 a month and they don't have a lot of extras to take care of. They have a small park but it isn't gated or anything. No pool, no clubhouse, I looked over their financial report and it seems like they have low reserves also somebody is benefiting.

70 a month for street lights and landscaping?? lol, for that cost, they better leave you alone. I paid 75/month for my previous HOA, and it included 2 pools, spas, tennis courts, free use of a fully stocked clubhouse, use of boats on the lake, and a golf course. But to your point specifically, all HOA's are the same anywhere you are, it really comes down to the people, since the HOA doesn't itself enforce the CCR's, they relay on self appointed street police to report up violations. So you could live a street where the neighbor doesnt care, or you might live on one with a window nazi. its luck really. Like I said, I lived in my HOA for 7 years without a single issue, once I moved out and the property became a rental, since owners hate renters, they do everything they can to annoy me regularly.

ya that security is a real piece of work. we go there often as we have a lot of friends who live there. One time, my 10 year old daughter was at a friends house there, and my wife went to go pick her up and she left her drivers license at home, and even though she was called in, and had the little pass they give you, she didn't have her ID to compare to the pass, they were refusing to let her in. Even after saying her daughter was in the community alone, they were basically saying "sorry no, your not going in." My wife flipped out, and said "ok, so when I call the cops, should I let them know that you specifically are holding my daughter hostage, since your preventing me from getting to her?" and the security idiot kid said "sorry." she just flipped him off and drove in, the security actually called the cops, and said someone ran the gate. The cops responded and pulled my wife over, and after explaining it, the Sheriff deputy flipped out and called the security company onsite manager and let him know that the next time they do that, he will arrest the manager personally. Im not into the whole "blue line red line" thing, and I hope me being a firefighter didnt make a difference since my wife car has a firefighter plate on it, and he would have responded the same for everyone who that security did that too.... But the security is still a collection of real dicks to this day...

Longer list than the wife needs to know about....
If your HOA is reasonable typically that rule is in place to prevent people from having a rusted out 83 Camaro sitting in the driveway that "I was going to restore" for the the last 15 years.... No you weren't stop lying to yourself... For the occasional weekend warrior who wants to change the water pump on his car this weekend they wouldn't care."Most" HOAs are reasonable not "All" however. This is predicated on the assumption your HOA is run by reasonable people, there are those that are run by single ladies in their 70s that never had kids with nothing better to do but wander around the neighborhood and find reasons to piss people off.

My suggestion talk to the HOA before buying the house, if she's wearing a cat sweater f*c!ing run.

Read my post again. $70 FOR THE YEAR.

To you point. In my experience the HOA's(or the people governing them) are a lot better here in TN. They are far cheaper and far less authoritarian. We like freedom here. Other places, not so much.

sorry my bad, I just saw 70, and since HOAs are usually monthly dues..However, freedom aside, im the sure the HOA rules there allow the HOA to do the same as they do anywhere else in the country depending on whether the HOA is run by pricks or nice people.

edit. actually I found that Tennessee is worse than most states...lol, so its all up to the people.

"Tennessee law does not limit the fines that can be imposed by single-family HOAs. Six states set a maximum fine that HOAs may impose, ranging between $50 and $500 per violation. Tennessee does not. "
