Circling back to the topics of parenting I started late in life. So I'm hoping they cook me dinners and change my diapers when they fly the nest.

That's the magic of trusts compared to wills. wills can go to probate on the protest of a creditor, disappointed family member, or that sanctimonious armadillo you tried to shoot last year for tearing up your yard. A trust stops most of that in its tracks.

 

We have a family trust and a “special needs trust”, which I think basically makes my younger daughter like Switzerland or an off shore bank account.

+1 on the estate lawyer. Every state could have nuances too. I know Legal Zoom has self-drafted options but there could be pitfalls with that.

 

When we set our trust up we almost used a self draft option, but decided against it due to not being fully sure that we were making all the best choices. Lawyers fees are worth it sometimes. And you won't hear me say that often.

 

I started with a self-draft, but the wife has an attorney look at it. I know I can be more comprehensive than most estate lawyers - they use boilerplates - but as to the language being defensible in court, it's better to have the lawyer chime in.
