    Good day folks,
My wife was hit by an out of control van while driving out 2019 Limited Crewmax Tundra, with only 8000 plus miles on the odometer. Thank God wife was safe. As you can see in the pictures, the rear left side of the truck is smashed and the axle was twisted causing the drive shaft to dislodge. The truck was insured for Total New Car Replacement with out insurance, but the van's insurance are now taking care of the claim.
Question for those who have experience:
Can the truck be deemed totaled? The truck's value was just over $55'000 when we bought it last December, and it was paid for in full.
We want either a check for the value of the truck or a new truck.
How much do you estimate the part and labor to get this truck fixed? What is the threshold for such a truck to be deemed totaled?
    Thanks.

If they do want to total it, remember that you can negotiate for that total

We only learned who the van's insurer was a few days ago, after 12 days of waiting for the police report. The truck is still at the Collision center and we have not heard back from neither them nor the insurance company yet about the final verdict. The tech initially said it seemed like it was totaled, but then changed his mind and said he might have jumped the gun and he would rather take the damaged pieces apart to check for any deeper damage.

That truck will never be the same again. With only 8,000 miles and a lifetime to go I’d push for a brand new one. Why accept anything less then perfect.

Remember your insurance is for you as well. Claim with your insurance and pay deductible. Then when they pay your insurance back, you'll get the deductible back. If their insurance isnt moving fast enough, get yours involved.

This is great advice. When my wife was hit, our agent fought for immediate payments from the other party

Damn. I'd be shocked if they didn't total it. Cab damage, bed is gone, entire rear axle, driveline. Wouldn't be surprised if transfer case is out of whack, maybe even back end of the tranny. Betcha your replacing Big T soon. Agree on your insurance comments, most will low ball or drag out. Wish we could low ball or drag out our rates/payments.

If they come back with a final verdict that is NOT what you want then by all means get your agent involved.

Very sorry this happened to you and glad no one was hurt.

Damn and I thought my recent accident was bad when my parked tundra was hit. After the shit show I just went through to get my truck fixed through someone else's insurance I say pay the deductible , use your insurance and let your go after the money from their insurance company. In my case I had to fight tooth and nail just to get them to tow my truck back to my home state of utah because it happened 1000 miles from home and it took them over a month to finally get it fixed. E very step of the way was a fight. In retrospect, pay the deductible and let your insurance fight and or sued the other insurance. It is worth it.

If I were a betting man I would bet that was totaled.
    Glad it protected your wife.

One other thing I thought of though, if that frame is damaged which I cant imagine it not being with that amount of damage and the c channel rear section,I don't see how they don't total it. Insurance companies generally aren't into frame repairs.

The first thought that crossed my mind after seeing the photos is "that frame is definitely tweaked". Too much cost and liability in frame repairs, and the truck will never be the same.
Fight for a new truck OP!

I waited 5 years to get my deductible back when I did this. I would not recommend this option.

I rebuild wrecked cars on the side and this week I looked at two Tundras with less damage than that that were totaled. Both were 2019 models.

I've never been let down by my insurance. Obviously if it took that long theres more to the story. Or the person you hit didnt have insurance therefore you only get money back once its collected. And I dont know what everyone's deductible is, but less stress and speedy results is worth the 500 for me. Even less if the motorist was uninsured, mine drops to 100.

Insurance will always try to pay the least amount and yes it will be a fight every step of the way. This has been my experience anyway. Good luck and glad to hear that your wife is okay. Please update this thread with the outcome.

Did y'all get a look at the van? Was it a mini van or company van?
I try not to be a sue happy person but, if it was a company van I would try to find out WHY the van lost control. If it was negligence due to something like bad tires that don't grip well in the rain then I'd say a negligence suit may be worth your time.

Man that sux. Glad the wife is ok.
Remember, if somehow they say 'fixable' you still have a loss. Truck loss of value due to being in an accident, and just fixing it isn't enough. They need to pay for the loss of value; the truck is not worth what it was worth before the accident. Totaling it is what I would go for here, I would not accept a truck that will be worth less when it comes time to trade it or sell it because of this in its history.

x2, I'd be pissed if they didn't total that truck out. Modern cars are tin cans that can't take a hit anymore. It's never be right again.

At least your wife is alright. The rest is all just headaches and nonsense... fighting with bean counters who want to maximize every dollar you pay them for insurance and pinch every penny when it comes time to pay a claim. Unless your policy states otherwise, and almost none do, they’ll be putting that back together with barrels full of aftermarket crap... from the big parts right down to the fasteners. They’ll be repainting it. It’ll never be the same. Best advice I’ve ever seen as you negotiate the value if they refuse to total it is the ask a dealership to give you a trade in value right now... as is... get a new truck and sign that one over to the dealer to auction off when it’s sold. The diminished value on that after an accident this significant will be substantial... 15% or more if I had to guess. You’ll be fighting with the insurance company about diminished value... they never want to talk about it. And if they total the truck, prepare for a wholesale offer. You’re probably better off using your own company and letting them deal with recovering from the other company in a case like this IMO.

As for whether it’s totaled.... did the air bags deploy? If they did, I’d say it’s a lock that it’s totaled. If not, ugh, it’s so new and worth so much that would pay for a lot of repairs and a bunch of second rate parts.

Your deductible was what? 500? $1k?

If your rates didn’t increase and it was of no fault to you,why not pay to have it handled to your satisfaction? Why take the run around and the headache?

You have the option to let theirs handle the claim or file a claim with yours, your's will settle your claim with you and then go after theirs to get paid back.
I'd deal with my own, thats what I pay for.

    Glad your wife is OK.

I had a similar experience just over 2 years ago. Had a 2017 Ram and got t-boned by a texting driver. Truck was less than a month old and 2000 miles. Frame, rear axle, cab, bed were all toast.

My first suggestion is to file a claim with your insurance IMMEDIATELY. You will get your deductible back, and I promise you that the couple hundred bucks is worth not having to deal with the at-fault insurance as much.

Give your statement to your insurance and do not talk to the at-fault insurance. They will twist your words and story to try to place blame on you. They will also try to make the entire process as painful as possible in order to get you to settle quicker and for a smaller settlement.

Since my crash was a side impact and my front air bags didn’t deploy / front end / motor were alright, the body shop could not get the vehicle totaled since the vehicle was so new and worth so much. Found out that in AK that a vehicle is only totaled if the damages are over 75% of the vehicles value. Body shop said they could swap the front end of my truck onto a new frame / bed / axle / etc and not hit the $40k in damage threshold.

Was a huge mess and ultimately filed a claim with my insurance. They took the ball from there, and ended up totaling the truck because they have a clause where they will not insure vehicles with over $30k in damage repair.

Good luck going forward, and again, FILE WITH YOUR INSURANCE AND LET THEM DEAL WITH IT.

This is what you want to do. With new car replacement, it is an easy decision. The other insurance carrier will try to hose you on value.

I can’t imagine that it’s not a complete total. That is a significant amount of damage.

I was rear ended a couple weeks ago in my 2019 Platinum and then pushed into the car in front of me and the damage doesn’t look all that bad but it was still 15k in damage. Mine has no frame damage so I’m not worried too much.

but in your case, I would definitely fight it in they aren’t going to total it out. That thing will never be the same again.
