    In my experience; they hit V1's limits, then move down the food chain of insurance companies; extremely rare to go after the individual unless limits were lacking or uninsured, but even then... can't squeeze juice from dried out fruit!

    If the dude is rollin' w/minimums, it's usually a good indication that they have nothing substantial to protect... makes going after him personally a giant waste of time, effort and money :mad:

    Your insurance will handle you and what happens subsequent (increases, etc.) will unfortunately be collateral damage. Sorry you gotta deal w/not only the damage/loss to your rig, but the personal kick in the nuts as well...

    They don't give a sh!t. I just went through all this same BS when I was rear-ended earlier this year. Dealing with my insurance company sucked. Trying to get my parts off my truck sucked, too. They acted like I was trying to steal my own stuff back. Crazy Crazy.
    All in all, the whole ordeal took like 4 months. And I lost many thousands of dollars. Luckily I owed far less than what the truck was worth, but I was still out lots of money in after market parts, taxes, etc etc.. Plus, when I bought another one, the interest rates were no where near what I had on my old truck. So lost lots of money there. All for something that was in no way, shape or form my fault. I'm still fairly bitter about it, haha.

    The worst part is being punished for something that you didn’t cause. I’ve never been in an at fault wreck in my life and haven’t had a ticket in over a decade. Now I’m gonna be out thousands and have to pay extra for insurance. :ballchain:

    I really should call my insurance company and up my coverages. Something like what you are going through weighs heavy on my anxiety.

    Even at state minimums his insurance should be covering some of it for you and the lady he hit, right? Are they splitting that between the two other vehicles, or is it in order of those hit?

    Just my truck is nearly worth that…

    I have 100/300 for property damage on my insurance policy so I’m not screwing other people over. My insurance lady was telling me the state minimum for PD in California is only $5k :eek:

    Really? 5K? Wow.

    I would think they'd do 25K toward yours and 25K toward the lady he hit, and he's on his own for his stuff. That would at least easily put your insurance into covering the rest and covering whatever your deductible is. Granted, if they go all in on the lady's rig then I doubt there'll be much left for yours.

    The way they explained it was that it’s $25k per car OR $50k per incident, and since the other lady’s car was obviously totaled his insurance was sweating from the get go

    For sure. Especially when there's video like what you have. There's no way out, they are paying everything his policy covers. At least you'll have 25K covered on yours, and you can use that club on your own insurance. If they try to lowball you can very clearly point out that they are getting off way cheaper than the full value because of the at fault's insurance and you don't want to be jerked around by a company you're paying. Hopefully you've been with them long enough to swing the loyalty cudgel as well.

    You’re very right. I’m counting myself lucky at this point! If the hit was hard enough to tear a section of the frame off and twist another portion, I can’t believe I didn’t get hurt.
