Property line dispute, anyone dealt with this?

    This certainly isn't definitive either, but looks like the boundary is supposed to line up with the end of the road/beginning of neighbor's drive based off the assessor's parcel plat. Looks like your lot is supposed to be 100' wide between the neighbor on your left and right.

    Yea, and when i go from the fence post on the right side neighbors and measure out 100' it lines up with the line i drew on the first photo (which lines up with my fence). I think the old neighbors built their driveway further out into the asphalt when they did their whole "revamp". They did a lot of shit without permits which has become obvious to me.

    Not sure if i mentioned it in this thread, but when we first bought they house, they were building an "in law" suite right up to the edge of the fence. Well, someone reported it to the city while the house we bought was up for sale. I think they always thought it was us, but regardless they had it basically done....had plumbing running and all. They had done the whole thing without a permit, and had to tear it down.

    Just for some perspective, we are down roughly a 1/4mile private drive from a cul de sac, so it's pretty secluded for california big city terms. The old owners were the original owners of the house when it was built in the 70's (well, the wife grew up in the house, and bought it form their parents sometime around 2009-2010 where they did a complete renovation of the property).

    Yea, we have this, but we've been told there are no pins anywhere, so we dont know where to be measuring from.

    Had a similar issue but not a dispute with neighbor. Bought a 10 acre lot a few years ago that was priced extremely cheap because there was no "Legal Lot of Record". Essentially, the size and dimension of the lot was not "recognized" by the City, County, and State. The Sellers opted to pay for all legal fees as long as I was up to do all the foot work. They've owned the property since the 40's and was grandfather in so they didn't have to deal with all that issue until they sold it. All-in-all the Sellers paid close to $30k for all the legal fees + 1.5 years of research, submitting, and waiting for local government for approval + $2k out-of-pocket survey. But yes, an attorney and survey will make your case easier. Good Luck.

    My neighborhood in Los Angeles, built in the 1950's, there are small "+" marks on the edge of sidewalk closest to the property. Mostly worn off now, but still visible if you know where to look.

    I did a little work for you. but, it's really up to a licensed surveyor, (disclaimer) I am not. I was in construction for over 35 years and learned a few thing, but, I could be wrong.

    Looking at Google street view, if your back fence is on the property line, it looks like they not only took 10 feet of your front yard, but the shared access road too. Sure makes their yard look bigger.

    I think you're probably arguing over inches. I'm a civil engineer/surveyor. A subdivision that recent and that $$neighborhood$$ will have plenty of property markers to determine your lot line ($4k is nuts, even for CA). You could probably find someone who can stake it out for about $1k. I google earthed your lot and measured off your neighbors fence. (I know you can't exactly hold that fence line, but in a neighborhood like yours they will usually have it surveyed first, and kept on their property entirely).

    You basically set me up right where I think I’m suppose to be.

    Side note. The neighbor on the left where you measured from use to own this whole subdivision and they split it up in the 70’s to the current lots you see (streets named after them).

    I went looking for the marker on the oak grove side with no luck. But it’s also pouring down rain.

    You have a 20' easement going across your front yard for your neighbors access. Those two front pins would most likely be on the other side of the pavement, not on your side. You might be able to find them with a cheap metal detector (make sure iron is not shut off).

    If you get your corners located, and not a full survey you save bank. Usually 500 bucks versus a few grand.

    OK, So lets say that you finally convince your neighbor to relinquish said property. Or, you just take over what you think is yours, based your speculation. Go ahead and spend $10K - $30k or more for grading, concrete, wall etc. Park your trailer and cars there.

    Then your neighbor decides to get a licensed survey and marks off the property. What if you are wrong by even a few inches? Who you think is going to be ripping sh!t out then?

    Don't be cheap and dumb. Get the survey from a licensed surveyor.

    like above. if anyone is putting any merit or hanging their hat on county GIS views/pictures, or any website that shows a property line, you might as well be punching yourself in the groin.

    Do NOT try and hit the easy button on this, you will get burned.

    The last 3 places I've purchased (And currently about to purchase again) I've thrown ~$500 at a local licensed surveyor to mark the property corners. One time I lost 25 feet on one corner (10 acre lot) the others were within a couple of inches. The one I lost 25' on was a blessing since I was going to fence it, I would've been PISSED if I had to pull it down and re-fence years later.

    with a surveyor, it's an independent 3rd party that is showing both sides what is in fact REALITY, not up for interpretation. I can't believe that this is now on 6 pages and folks are speculating on what you should or shouldn't do, and you seem to be putting any merit into websites or opinions.

    Don't play around with this, this is a business/financial situation and as such, don't trust that your neighbor will do the "Right Thing" they won't until they have to, full stop.

    Get proof of what is yours and take it back . You can dilly around and try to be a nice guy. Chances are the neighbor already thinks you are a D'head. Thats how the "entitled" think.
