    If you truly want a buyback under the lemon law do it through the BBB. They will go to bat for you and the manufacturer will respond quickly. I live about a hundred miles away from you in Oregon and back in 2013 had a similar problem with a mustang that the dealership could not figure out. I filed request to exercise lemon law with the better Business bureau and within 3 days I had been contacted by the Manufacturer and they sent a master engineer out to look at the car.

    ***UPDATE***

    Dropped the truck off to the dealer this morning, got a call from the dealer this afternoon saying a toyota assistance case was opened and the truck needs to stay longer so they can do more disassembly.

    I asked the tech what codes were thrown and he informed me it was a misfire code and they found metal shavings (don’t know where).

    I will update when I know more.

    I also opened another case with corporate to start the arbitration process for a return or replacement. In any scenario, I am trading the truck in. Done with the gen 3s for now.

    Feels good and seems fair but bad advice. That will have no impact on getting it repurchased or repaired. It will only impact the owners credit. if it does go to a buyback that process will reimburse for finance charges.

    I just went through this and it's a shitty place for you right now but you're doing everything right. The dealer also did the right thing to open a case. Much better to handle it that way rather than come up guns blazing with an attorney which forces it to the letter of the law. Three attempts to repaid and 30 days or thereabouts.

    Just for clarification for other people in the future. The dealer did not open a corporate case. They have been nothing but grimey and shady offering no help whatsoever. Same with the first case I opened with corporate, they just hide behind the dealer.

    This is my second corporate case I opened, the first one they told me to kick rocks. This one, I requested arbitration to return or replace the truck. I doubt it’s gonna go in my favor (same case manager again). I have a lawyer already retained and waiting.

    Saw you were in OR, if you want to pursue the Lemon Law route or see if you have a legit case look up Danielle Beauvais out of Portland. I went through the lemon law process with my Wife’s old Jeep and she made it super simple.

    They are required to give you a loaner as per Toyota. As for not paying back the loan, bad move on that suggestion.
    Toyota, the dealer and everyone walking by have NOTHING to do with loan.

    Thats a deal between you and the bank. Don't pay the loan, they will start calling for the money.
    That doesn't work they will repo the truck and go after you.

    Sure you may feel that you shouldnt have to pay for a truck thats broken at the moment, but for every issue we have we just don't stop payment. You'll have a loaner, beat the heck out of it. Enjoy it. In the mean time the truck will be dealt with one way or another.

    You should Qualify for ADA (Americans with Disability Act) that protects you from using PTO. Check into it
