    Isn’t it nice how we all come together as a community in a show of solidarity and goodwill to help a person that we don’t even know who was wronged. And by that I mean voice our, mostly meaningless, opinions on how he should best get vengeance, I mean restitution, wait no, I mean justice. Yes that’s the word I’m looking for. ;P

    To the OP:

    You might want to get the State Attorney General involved (state where the dealer does business). Fraud is fraud and most State Attorney General's have an office that deals with just this kind of situation.

    It's free to contact them and file a complaint, and you have nothing to lose but a bit of time.

    We did this once several years ago regarding a warranty issue for a, not cheap, product we had that supposedly had a lifetime warranty. Took a bit of work but once we got our State Attorney General's office involved the company made good with our request with a quickness.

    You milage may vary. But, worth a shot.

    So, basically made you pay for all the losses on this one and he's walking away scott-free. That really sucks.

    That's the beauty about small claims court. You don't need a lawyer. It's a one-shot, one day thing, and you can actually request him to pay for travel expenses in court also, which any sane judge would rule in your favor on both accounts, the truck, and the seller. There are specific laws in his state to cover you.

    But I totally get it if you don't want to. However, don't discredit the power of paying an attorney $100-200 to form-letter the guy. Sometimes just having a legal document in-hand (which is real, and not just words on a phone or in email) will tip the scale.

    You could probably get this guy for far more than the $4k. What you've invested in this in time, money, and emotion is a calculable, tangible expense.

    I agree with this. Also small claims courts tend to support individuals over businesses in situations such as this.

    One does not simply rip somebody off for $4k and just walk away. Keep in mind, they TRIED for $25k, so they’ve agreed to settle for $4k? I don’t fucking think so. How was anything other than full price paid even an option?? Letting it go, taking it as a lesson, etc. would never cross my mind. Like others have said, there are principals people should live by. The seller is the one that needs to be learning a lesson here, not the OP, who has clearly and blatantly been victimized. And I agree that they’re HOPING that you’ll just get over it and they never hear from you again. Yeah don’t bother them while they’re out having dinner and drinks on your dime. Fawk that horseshit. If you’re gonna dance on my grave, you’re gonna do it with broken legs.
    Yes, have a legal professional send a letter including the laws and whatever else, so they know that you’re not ignorant, and that their repayment amount is unacceptable. Like right now. If that doesn’t work, I’d move on to step 2, then step 3, etc.
    Something else I have not seen mentioned yet, do not cash or deposit that check! I’m assuming you were delivered a check when they picked up the truck, or whatever. I’d almost guarantee somewhere in some paperwork issued to you that you’ll find it stated that - by cashing the check, you’re agreeing to accept the $21k to finalize the transaction.
    One more thing, please confirm that your not buying the 2nd gen from the same seller.

    That really sucks. I would think word of mouth for a smaller dealer would be enough for them to do the right thing. I'm sure you are relieved to be out of the situation but man 4k hurts. but if it doesn't hurt enough to worry about it, live your life and be happy. sometimes that is worth more than the money.

    A friend once had trouble with a car from a dealer. They kept giving her the run around. Finally, she parked her car in the entrance to the dealer, threw open the hood, and stopped every customer going in to buy a car. "Are you going in there to buy a car? Don't do that! Listen to my story...". Not long after the manager came out, invited her back in, and she settled her complaint.

    I know it doesn't apply here (dealer in KS), but social media can have the same (or greater) effect.

    Don’t give up and accept a $4k learning fee. Fight and get your money back.

    Does the reimbursement paper say paid in full? That could stop any further collection effort. I would say do as one suggested to contact the State Attny claiming fraud and ask for recourse advice while hearing their response, or get an attorney's advice if further recourse for reimbursement is possible. The OP does seem to have left for good, though, but all said is good for others to think about if screwed in the future.

    I would expect that the dealer could face some sort of criminal negligence by relisting this vehicle that is documented here to not be road worthy. What if someone else buys this truck and ends up seriously injured or dead due to a frame failure crash?
