How do you Sell your guns?

No, that wouldn't be legal either.
It is my understanding that an OK FFL would have to ship it to a Texas FFL.
You can't just go across state lines and sell it, LEGALLY..

 

No, you don't have to drive to TX. To do it legally you go to a FFL in OK, you tell them who you are transferring to. The OK FFL accepts your firearm into his books. He then transfers to an FFL in TX. The buyer then goes to the FFL and completes a background check, or shows a CCW. The FFL in TX then transfers to the buyer.

In this case you pay both FFL for transfer services. Usually $25 but sometimes as low as $10. So that's $20 to $50 plus priority shipping fees.

This is the only legal way to do this.

Not entirely true.
If OP delivers the firearm directly to a TX FFL, then it is perfectly legal for a TX buyer to purchase. It is not necessary for it to go to an OK FFL first. Seller can ship direct to FFL (as long as the FFL is willing to accept shipment from a private seller), or can deliver in person. You just can’t ship handguns via USPS as a private seller.
I’ve done it several times between WA and OR - both as the buyer and the seller.

 

OR, you can sell it to a RESIDENT of Oklahoma (that can legally own a firearm) with a handshake and a smile.
No FFL, no 4473, no sh!t.

But if you filled out a 4473 when you bought it, the Feds may be knocking on your door, if the gun is ever confiscated..
Then again, they may not...

I've bought and sold privately using a bill of sale and not using bill of sale..
I've yet have the Feds knocking on my door...

 

It does suck but those are the hoops we must jump through.

Either way it jacks up the price (transfer fees) and ties the gun to the buyer with a 4473..
I'd rather not have the Feds knowing what I buy privately if I can help it..

 

I have always been under the impression that you need to first transfer to a licensed FFL in your own state before transferring to a resident of another state. My 6 minute research tonight kind of confirms this, but could be inaccurate.

Anything across state lines. Unfortunately, here in WA and OR, BGC and 4473 is required anyway.
I’ve got some from before that was the case... and those won’t ever get sold for that reason (and they have sentimental value).

Nope. Just has to be delivered to the buyer by an FFL in their state of residence with all the necessary paperwork.

You're right. Not sure why i thought you needed an FFL on both sides. I know you can send to an out of state FFL for repair or other work - not sure why I thought you couldn't for sales.

It's sounds like you need to tell the "finder" the approximate location of where you lost your gun, and they need to tell you where they lost some money.

 

I'm guessing this is all designed so the residents of CA and NY can't bypass the castration process. Or the gun dealers have really good lobbyists.

A few years ago I put a Marlin 308 lever gun up on Armslist, and in the first 24 hrs got a call from a guy in Texas that wants to buy it (I’m in CA). He identifies himself as a circuit judge, and I said OK, I’ll sell it, but it’s got to go from a CA FFL to a Texas FFL. Long story short, he buys it, and it was a clean deal. I sent the ammo via UPS from my home to his home, and not necessary to use an FFL. Today, because of changes in CA law on ammo sales, that wouldn’t be possible.

 

HaHaHa... the FFL's have a vested interest in keeping you folks terrified of selling your guns without running it through them first for a fee. There may be some state's that this is pertinent to... but many that it isn't.

Not necessarily true. Long guns and shotguns can be purchased from an FFL in Neighboring states handguns cannot. I.E. I live in Indiana I have purchased long guns from FFLs in Kentucky in person.

Did something in the law change recently? I ask because in the past only the receiving FFL had to log the seller and buyer and have you complete the 4473.

 

I hear you on the paperwork. My FFL charges me a flat fee of $10.00 for transfers. Which is more than reasonable. I do have to fill out the form electronically... which is a little unsettling.

 

From what I understand and have read, if a private seller wants to advertise a gun for sale and then meet the buyer in person, the transaction can legally proceed like any other private gun sale. they don't have to go through an FFL holder.

 

Only if both persons are residents of the same state.
