Officer has no case if what you've said is true. To be DUI you must be driving. A case cannot be made on your story, there isn't even circumstantial evidence, let alone real evidence.

I was on a jury where a guy got pulled over leaving a bar, complied with officers completely and couldn't be breath tested in the field. He passed all sobriety checks but smelled like beer so they took him in. He was tested an hour later at the station and blew over limit. He got off because they could not prove beyond reasonable doubt that he was over limit while driving.

This was in California. The reason he was pulled over was mud on his license plate.

 

Wherever you were in Rancho, is there video/witnesses showing your girl driving? Did you stop for gas somewhere, possible video showing her driving?

On average, it takes 2 hours for ones body to fully metabolize 1 STANDARD drink whether it be 1 beer, 1 wine, or 1 shot. If you have 2 20 ounce Coors at a 4.0% ABV, over the course of 4 hours, you are still going to be over the 0.04 impaired level. A 180 pound man after 3 standard drinks within 2 hours is over .08.

My wife is a Certified Alcohol/Drug Counselor (CADC for short), I get to hear this speel every. single. time, I drink. Gets rather annoying.

I agree, but we have had a boom of home grown brewers that make a pretty nice beer down here.

But then there is the 300+ micro craft breweries here in Colorado with some of the best beer on the planet. Some well over 9%. The Great American Beer Fest is held here every year in Denver. Easier to get free Super Bowl tickets.

It's .05 in CO - .05 to .079 is DWAI (Driving While Ability Impaired). DUI starts at .08 and up. To get you on the DWAI, DA only has to prove impairment to the slightest degree. DMV implications start at .08, unless you refuse to take a test or the criminal case goes south.

A full glass of wine and my wife can't drive. It's ridiculous, but not changing anytime soon with traffic fatalities up.

 

Oh yeah the benz is a normal looking car, I dont even get looked at.
But when i had my subaru I got looked at all the time and that car just got way to much attention, thats on of the reasons I got rid of it.

 

The CO craft brews also make it more complicated. A buddy left the Southern Sun in Boulder after having a taster glass and then a pint of a new special release. Hadn't eaten, smaller guy. Got pulled over for speeding and got charged with DWAI. Even Southern Sun wasn't entirely sure what the ABV was.
