Accident on 1/8/2025

    So it’s State Farm vs State Farm. We just had to pay out of pocket to bring the truck back home because they were not prompt on moving the truck to their own storage facility from the tow yard it was brought to. Over $600 paid leaving the truck there for 2 days.

    When the adjuster called, they said “Well unfortunately, the other party also has State Farm”.

    This made me BOIL.

    I’ve got an MVA lawyer lined up and we’re creating a case. 4 cases vs other party.

    For those in the legal world, what else should I be doing to stay ahead of State Farm from screwing me over?

    We’re going to make sure we get compensated properly.

    Lost of wages, broken thumb, my youngest is now TRAUMATIZED being in the car.

    Get your truck fixed. Get your medical problems taken care of and the bills paid. Insurance is there to pay for these things in an accident. Stay calm. Stand up for what you are owed. Get real familiar with your policy. I’m assuming the other party was at fault?

    I had GEICO then switched over to SF for a few years. We had a small (~$10k) home insurance claim that they used to up our premiums by about $900 then incrementally after that (statewide rate increase, regional rate increase, blah blah).

    Couldn't wait to get away from them. They did CA dirty by canceling policies and pulling up stakes over there, and I've heard several stories about them shafting ppl on auto claims... Unscrupulous company.

    Not that I like SF and would never use them, there was a very good reason that they cancelled the properties out in CA.

    I hate insurance companies. Allstate did the same thing to me after replacing a roof due to storm damage.

    HOWEVER, I'm not sure State Farm is the bad guy in the wildfire situation. California has not only left all of their woodlands alone (no forest management, controlled burns, etc), they let their reservoirs run dry by literally dumping freshwater into the ocean. There is a small fish called the Delta Smelt in the California Delta that only survives when its waters have a certain amount of salinity. To help the waters stay salty, CA directs freshwater (much needed freshwater, mind you) into the ocean instead of filling reservoirs that could be used by fire departments.

    The current situation has been a long time coming unfortunately.

    CA also passed legislation preventing insurance companies from raising premiums while at the same time dramatically increasing risk of fire due to the previously mentioned lack of management. So a lot of people's policies got cancelled.

    I see. It’s not that the reservoirs they had weren’t stocked; the system was woefully ill-equipped.

    If your tanks can be ran dry in 3 hours of fighting a fire that you did absolutely nothing to prepare or control for, you simply didn't have enough water.

    If we've done nothing to prepare for it, why is it much harder to build on my land due to increases in setbacks that are required by the fire district? Why did the fire district go through many people's neighborhoods and require us to clear defensible space from our houses due to local laws?

    Anyways, this thread's getting off topic. Should get back to auto insurance and stuff like that.

    No one is blaming residents personally. I'm talking about the state's forestry management, controlled burning in particular, that only resumed recently after being ignored for a very long time (too little too late).

    I have friends out there who are in danger of losing everything. Frustrating all around.

    Anyway, I'm bowing out. Probably not a debate that can keep from running afoul of site rules.
