    Not sure Henry. So much happened in less than a second. I do not remember any warnings. Even at max braking, there was no chance I was going to avoid a collision, plus I'm not sure if TSS is much help with vehicles coming from the side? I thought the anti-collision was more beak-to-beak. Apparently, my natural cat-like instincts are not cat-like anymore.

    Thanks Steve. Definitely a broken rib from the seat belt I'm guessing, plus $20,000 worth of damage which Progressive (at fault person's insurance) doesn't want to pay or at least "dragging their feet." However, I'm not in the hospital enjoying Christmas....thank you Toyota.

    Consider meeting with a personal injury lawyer. Accidents with damage to your vehicle and body are very stressful times and they will handle virtually everything. You need to make sure you get your just compensation to MAKE YOU WHOLE. My wife was nearly killed in an accident when an F-250 crossed the center line and hit her Honda at 55mph. $100k in medical bills and an uninsured driver at fault. I could not imagine navigating that process without a lawyer. 33% of a settlement is a small price to pay for knowing everything was handled to the fullest amount of the law. You need to make sure this isnt going to spiral out into years of medical therapy that you are footing the bill for. DO NOT SIGN ANYTHING OR ANY SETTLEMENT FROM THEIR INSURANCE until you thoroughly understand what you are signing or a lawyer has advised you.

    At the very least the lawyer will tell you if its worth signing an agreement during your consultation.

    LED lights,Rear sway,tint,cover,liner,cat protector,skid,running boards,mats,pedal commander,tint, and $$$ etc etc.
    2x above, they are going to drag their feet, your first time, many more tricks coming your way, damage estimate will most likely increase when they really open it up and start adding cost,(you mentioned $28K)it might get there, add your medical, DV, etc. Ain't nobody going to be your friend in this game.

    Been in many, tried some myself, but gave up a long time ago, 67% percent is better than %? you are going to negotiate. Having no experience is going to be difficult.

    Ask around, go online, take a few hours, and select a competent attorney you can work with.

    Sometimes all the insurance company needs is a nice firm letter from a lawyer to realize that a proper settlement is much wiser than trying to screw you personally.

    Years ago I had a Honda Civic rear end my F250 so bad that her car was stopped by hitting my shock mount. I had to engage 4WD to get off of her hood. Every single fluid was coming out of her car. It was absolutely totalled. I simply asked the adjuster for a new spare tire and trailer hitch and he refused. He wanted to give me a few hundred dollars. I told him that he was damn lucky that I was not complaining about my neck. He thought about it for a few seconds and then asked how much those two items would be worth.

    Insurance companies will try and low ball you everytime. They will only square up once they realize that it will cost more in the long run than the settlement itself. Stick to your guns.
