Body shop says $9500 damage. Anyone know DV laws in Arizona.

    Texting girl rear ended me on I-10. Damage estimate is $9500. If she has insurance I am going to sue for diminished value. Even if she doesn't have insurance I will still sue her for DV and my deductible. She would at that point likely file bankruptcy but at least it will ruin her credit.

    Better idea sue the cell phone company for not locking her phone when in motion.. the technology is in our phones it's just unlocked so the phone company's can make money.

    Hope she at least got a ticket!! I don't understand how people don't get strongly reprimanded for driving without insurance! Isn't that against the law anyways???

    I asked the cop if she received any citations and he said he can not give me that information. Seems that at fault party has more rights than the victim in Arizona!

    When my wife's Camry was rear ended when it was a whole 5 months old, I tried the whole diminished value thing and got absolutely nowhere. They kept saying I have to prove value loss and that is hard to do. Don't get me wrong, it can be done but after a year of fighting it myself, I gave up.

    Tell me about it! That crap is everywhere!! Some woman rear ended my uncle with no insurance and cop let her go. Uncle's own insurance company had to pay for the damage. Ridiculous.

    Must vary from state to state. However, I wouldn't take your agents word as gold either.

    So why do you not know if she has insurance or not? Did she not have proof or what at the scene of the accident?

    Rear end accidents in these trucks are expensive. The hitch on our trucks are expensive.

    Might want to lawyer up. Best things I have done in accidents.

    She could provide no proof of insurance at time of crash. Insurance co is trying to determine if she was covered or not. I pray that she was covered or this is gonna get messy.

    When I realized that the wasnt injured I wanted to drag her out of her crappy little car and slap da chit outta her, but I dont like jail either. The whole time until I was cleared to leave the investigation she never exited her car....no apology or anything. She just hid in her car and cried for herself.

    The problem is that state laws are so lenient on the no insurance issue that there is no teeth in the penalties. If penalties were much stiffer law makers would be accused of being racist and unfairly targeting minorities......fact

    That is a bummer Grant.

    When I see threads like this, I am glad I upped my limits to 500K across the board, made sure I had no/under insured on my policy. Another thing to look at is an umbrella policy. Never thought I would need one...until I did.

    In Colorado, you might have to wait about a month and pay 8.00 to get the report. Actually, our lawyer had to press the issue to get the report at 30 days.

    I never understood that either Matt. It doesn't matter if you wrote a check for the vehicle. I really do not want to write another one in 6 months. If the vehicle has a value of over 3000.00 in my household, it has full coverage. (for us, it is about a 10.00 a month difference)

    Actually all you have to do is wait a few minutes and see if the LEO hands the other party a ticket. As far as the LEO report, my insurance company could get it ASAP. A month? are you kidding me?? If it was so bad where you needed a lawyer, you'd have that info in 24 hrs tops.

    If your vehicle is financed,(I'm talking about a vehicle that's actually worth some money) you have to carry FULL coverage, and GAP for example. If you pay cash for an expensive ride, it's on you to have enough coverage even though you don't have to.

    Not in our instance. He was taken away in an ambulance and in ICU for 3 weeks in a coma (was ejected out of the vehicle).

    Guess it is all situational, but it took us about 30 days. It wasn't a rush anyway, we knew this was going to be an 12-18 month ordeal....and it was..

    That's way beyond a typical fender bender. I still state that any police report filed can be procured ASAP. Nonsense to think that can be with held. Public info from the first minute.

    Oh I agree. Finance companies keep close tabs on insurance and require you to have full coverage. GAP insurance is not required, but it a good idea if you do not put anything down. I have never been in the situation to need GAP insurance.
