2023 TRD Pro Lemon Law

    Guy at work, against my advice, bought a 2023 TRD PRO for $92k. Yes you heard that right, $92k, that is why I advised him against it, on top of other things. Anyways it has been to the dealer 3 times now and has been seen by 1 engineer, apparently. It has a ticking/rattle noise that apparently is coming from the electric motor.

    1. Has anyone with the Max had this issue with the electric motor?
    2. He has started the buy back but the dealer is not to helpful apparently. Does he get everything back a the end? Making it like it didn't cost him a penny to drive it for x amount of months. Does this comes out of the dealers pocket or out of Toyotas pocket?

    The dealer is trowing him to the curd with no assistance at all. Which I dont dought because that dealer is garbage.

    A friend at work got a 22 or 23, I forget which one, but she got the dealer installed factory lift kit, which made it act all fucked up and after being stranded numerous times, she got them to lemon law it. She told me she did NOT get the sales tax back, which is pretty substantial on what was a 78k truck.

    The dealer has nothing to do with the buyback other than providing service information to Toyota and being the ones that accept the vehicle/paperwork when it is surrendered.

    Generally the lemon law (which varies a bit from state to state) includes purchase price of the vehicle minus reasonable use for mileage, plus any legal fees incurred. So he gets his money minus mileage back, the lawyer gets their fees. If the buyback goes through. Trying to complete a lemon law buyback by ones self is a frustrating process I hear. As soon as a lawyer is involved, everything speeds up. Still can take months and months.

    Yeah, I haven't needed to do a lemon buyback and neither has he, so I figured some of you would know. I can tell him what to expect now that I have some more info from you guys. I guess he has pissed off the dealer and that's why they aren't really helping the situation but I would be pissed also if my $90k truck has an issue that can't be fixed according to them.

    Horror stories abound on the forum, some warranted, some not. Take it with a grain of salt.

    I just sold my 2022 TRD Pro, and have a 2025 on the way. Couple recalls on the 2022 (one netted me four new tires - score!), others were small stuff. Other than that, the truck was great and I'm exceited about the next one.

    If this is the one you want, go for certified, and a warranty if possible, and enjoy your new truck.

    I think I will take my chance. It has Toyota gold certification. If there's any major issues, I'll look into the lemon law.

    It’s not a $92K truck. His dumb ass just paid that much for it.

    I wonder if Toyota will pay him back commensurate with the dealer mark up? I’ll bet they don’t.

    It's a pretty straight forward process. You must perform the milestones along the way without wavering from the rules. Document and retain receipts for everything. The most important thing is qualifying for it. The rules are very specific what does and what doesn't.

    PS: In Florida, no Lemon Law available for used vehicle. Only new vehicle to original purchaser.

    There's a string of "ifs" but if he is the original and bought from a Toyota dealer that $92K will be prorated from there. Whatever was on the Toyota dealers sales order
    If title transferred and the additional markup transferred through a middle man, it gets very difficult.

    Just clarifying question.

    So if OP's friend purchased it with a 10k markup or something, but he was still the first person on the title, he should expect a full refund? I find it unlikely that Toyota would payback for a dealer markup since they tell us they have no control over dealers regularly. But the law is the law, so if thats how its written...

    It's not the first person on the title. It is who is on the original buyers order on a new vehicle from a Toyota dealer.
    The buyers order is the primary source document to determine value that is then pro-rated for remediation.

    That's another thing. I could be wrong but I remember him saying something about it being a managers car for a while. It did have some miles on it, not much but it was still sold as a brand new truck. It could have been or not registered to the dealer already or something to that nature. As for the mark up, yes there was a mark up. What it was he didn't say. He had his head to far up his ass to see a bad deal even if it was $150k. All he saw was, I am going to look good in my $92k truck. I originally told him the Capstone was cheaper and that he would never off-road the truck anyways so why get it. I will see on Monday were he's at. He hasn't been to talkative to me about it because he's not happy about the whole situation. Not to mention he went to 1 of the most POS dealers in the area.

    I called this same dealer the other day to see if they had a fuel float switch in stock. MSRP is $133. They said they didn't and said the price was $250. Every other dealer I called was selling it for MSRP. That should tell what kind of dealer this is.

    Take it for what it is. It seems all vehicles are cutting corners and quality has gone down. As for the gold certificate, well my friend has full warranty, better than a gold certificate and still Toyota can't or won't fix it.

    Honda currently has the possibility of recalling 1.5 million engines. So you see, no car manuf nowadays is doing good.

    If you like the truck buy it and just like anything in life, hope it turns out well.

    There is a tsb out there to fix the rattling noise coming from the hybrid system when not moving but in drive. I believe it is TSB-0086-24. Supposedly Toyota can reflash something and it gets rid of the noise. My hybrid has the rattling noise but it can only be heard really in drive thrus and it isn’t all the time.
    Maybe your friend’s issue is not the same but the rattling noise coming from the hybrid system is a known thing and there are a couple post on this forum and on reddit discussing it.
    But yea I got nothing on paying 92k for a trd pro, that’s crazy talk.

    Yeah well, apparently they can't fix it. I told him to try another dealer since that one is garbage. But hell, he didn't listen to me in the first place when I told him $92k was wayyy to much for a 1/2ton.

    Yea I’d suggest a new dealer. You could give him the tsb and have him tell the dealer. But surely the engineer they sent out would have know about it.

    Maybe he just wants to get out of it given the engine recalls and stuff like that. But I don’t know how market adjustments work in regards to buybacks. Since the market adjustment would be done by the dealer and not Toyota. So I don’t know if Toyota would pay the adjustment back to him.

    Dealer drove it on the MSO, manufacturers statement of origin with a dealer tag. Normal. The MSO is used for the original title application which is why your guy is first and only on the title.
