    For the record I'm not culty Toyota folk, I'm just trying to understand the fucking lawsuit.
    I do know a bit about how law firms and lawsuits work being married to someone who has been in the legal field for over 30 years.

    The sticker says a Tundra with a tow package has a trans oil cooler, and from what I can see, it does.
    It just isn't the same trans oil cooler that they used before.

    Anyone thinking that Toyota is going to pay for what they define as a 'trans oil cooler' as opposed to what Toyota defines a 'trans oil cooler' is delusional.
    I'm not saying you feel this way, but the OP certainly does.

    We've already seen these ambulance chaser attorneys are ready to get money out of claimants if they don't get what they want out of Toyota.
    Attorneys get paid, this isn't a contingency lawsuit from what I read, I could be wrong.

    This lawsuit seems to be more about lawyers getting paid than any imaginary fears and/or issues and documented failures of the said 'trans oil cooler' in question.

    If I was a Toyota cultist, I'd be driving a Gen 3 right now.
    I have zero confidence in the Gen 3s and will not be purchasing one with the DAILY issues seen posted on this forum.

    I appreciate your answers to my questions in my quest to understand.:thumbsup:

    FTR - Was not directing that at you in any way.
    there are times when Toyota related employees jump in and throw absolutes around and it incorrectly stifles conversation.


    As I see it....that shitty cooling/heating puck, on my '20, serves the purpose of the Toyota definition of said cooler.

    and, we agree, it is an uphill battle to do so.


    and like others have said...I added the "original external cooling thing" because my transmission was getting oddly hot under zero load.

    I applaud good conversation....it's tough to do these days.

    analogy

    the cooling puck is like GM's CEO Mary Barra.

    yes, she is a CEO but:
    she is completely in-effective
    you could do without her & the company would function better
    it's hard to explain what she does
    in some, if not most, instances she is detrimental to the company

    I think what you might be missing is the puck heat exchanger was there in conjunction with the auxillary plate/fin cooler on previous models. This design used the puck to heat, not to cool. Essentially, Toyota deleted the cooling portion of the system without making the same change to window stickers.

    I'm not in this predicament so take what I have to say with a grain of salt. Because if I did have that model year I would not give my personal info to this law firm.

    Not all class action lawsuits benefit the end user. And it appears after reading through this shady firms disclaimers that if they fail and Toyota wins this case they will be coming after their own clients to get their money. I see no benefits to this suit for either Toyota to own up to any sticker verbiage or the end user benefiting from a win where Toyota agrees to install the trans cooler at a 40% cost to owners in the suit.

    I'll take it a step further and ask this question for you to answer. How safe is your personal information with such a shady firm? If they are willing to go after their own client because they can't win a case against Toyota and have it in writing already, do you think they would sell your info out for a few more bucks to line their own greedy pockets?

    The fight is over the sticker misrepresenting the product or false advertising, little to do with hot transmission fluid or the product design. Basically, the law firm is claiming what is true, Toyota used the same design in 19, 20 and 21 but changed the product label in 2021, probably after seeing complaints and lawyers looking at it.

    This is the key. I know we've all seen ridiculous litigation over some random bs, remember the McDonald's lawsuit they settled because a woman spilled hot coffee in her lap because she placed a cup of hot coffee between her legs while driving?

    She had damages to claim, even if it was well beyond her own accountability in the process.

    The question remains, where are all the failed trannys, because of a lack of a trans cooler?

    It's not failed trannies or design, it was false advertising and I believe they have a case for that and Toyota will have to pay for it. However, the law firm will be who collects, not the customers.

    there is a cooler/heater on there << the basis of the claim <I realize it's not the exact same cooler heater>
    the transmission is not breaking
    the truck does not throw codes under load

    so - say it's false advertising. <very tough to prove - see above>
    what harm was done?
    will the remedy be an original equipment install on those trucks?



    my '20 worked fine for 25k miles - Then I installed to "original" equip.

    You're spot on with what the fight is over. And also with how the consumer wont win much, if anything. I just have a hard time seeing a firm with 15 years cumulative experience getting Toyota to bend over when Toyota can argue that the heat exchanger puck is their "cooler."

    Edit: even if it is misleading, will it be proven in court under this grossly under prepared firm?

    Not hard to prove, same product, different ingredient labeling. Why? Obvious why, when looking at previous years and lots of evidence all over the web from customers being upset. Toyota realized they made a mistake or else the labeling wouldn't have been changed. IMO, it is clear as day. Now will the transmissions die early? Obviously those results will be all over the map because documentation of failure, usage and maintenance are variable, so proof could be difficult.

    I totally agree that they saw the complaints on forums and everywhere else which is why they likely changed the labeling. How it plays out in court isn't up to us squabbling between right and wrong though. It's up to seasoned lawyers to slime the case up in front of a judge. My gripe is the way the unseasoned lawyers are acting like recruiters trying to possibly hold their own clients liable for the bill if they fail at their job.

    I view layers much like mechanics. Not trustworthy and can charge what they want, even if they do a bad job.

    I called to follow up with law firm regarding this case, attorney said the total damages per claim is around $10k each.
    Looks like they’re following thru.
    asked when to expect a resolution and he stated they’re finalizing campaign but are looking at about 250 cases already signed up!

    We might finally get a resolution to this mess if they have their numbers right. Sad that toyota never fixed this on their own.
