Upsetting for sure. In the heat of the moment your reaction is very understandable.

I think in that place they should have a spotter of sorts to make traffic wait until he's done piling that stuff up. Pretty bad planning to have an unstable pile of metal along side the thru road. The yards I go to don't do that, you have an area where you drop off and drive away, they take it some 20 yards the other direction and pile it up where you aren't allowed to be. This is the sort of thing OSHA would go nuts over.

The good news is you're okay, the truck will be okay with a door/bed replacement. Doesn't look like the cab itself took any damage.

The technical name for the process is "subrogation". The best way for you to go about this is to contact YOUR insurance, always. You pay them; they work for YOU. The other guy's insurance company works for him. Your insurance company really IS on your side; they want to keep you as a customer. The best way to get insurance is to go through a local broker - that way you have yet another company on your side. (When I lived in MA, my insurance broker was a Brother in my Masonic Lodge - I never, ever, had any doubts about who Pat was working for - I knew he had my best interests at heart since he was my Brother.)

Let me guess - you never called the cops to take a report on this accident, right? That's why the other guy could get away with it; had the cops been called, the other guy would have been cited for DUI and the cop could have seen the accident scene first hand. That ticket alone would have made it very hard for the drunk son of a bitch to claim it was your fault.

Oh, and about your reaction? I would have very likely said exactly the same thing. Word for word. Don't worry about it.

I do have manual windows but I could totally see my best friend Mike, who has Aspergers like me, going on autopilot and trying to get in on this side...

The cops were called when the drunk guy hit me! Ironically, the drunk guy is the one who called the cops!

He was arrested at the scene and taken to the local hospital for a blood test; The BAC came back at like .16 and he lost his license for a year (I think he should have gotten his license permanently revoked, considering he KILLED somebody while driving drunk in the 1980s). I still have the police report from that night filed away somewhere; I ended up getting court ordered restitution from the guy, which I spend on dashcams and a killer new stereo with an integrated backup camera.

The fact that the police were called and the guy was convicted of DUI is why that whole situation pisses me off so much; Even though the old prick was convicted, his insurance company still refused to pay me because he insisted that I blew through that stop sign. At least two cops responded to that call that night, and they believed that I didn't run the stop sign, so I have no idea why the other guy's insurance didn't! I never got a ticket or even a written warning from the police, and my insurance company not only didn't waived my deductible, but also didn't raise my rates!

UPDATE: My insurance company (USAA) gave me an estimate of $3,890.20 to fix my truck last Thursday (February 17th); Yesterday, a woman from the scrapyard's insurance company (Liberty Mutual) contacted me yesterday (February 21st) and I am waiting to hear back from them. My body shop says a week to fix my truck, and Liberty Mutual will be paying for a rental car for as long as it takes to fix my truck!

Agree...and probably not the best judgement to be driving so close to that big piece of equipment while it is working....both his driving so close and the scrapyards letting him in there while that guy was working. Stuff like that never happens...until it does.

They owned up immediately and their insurance is footing the entire bill, so obviously they don't think it was the least bit my fault...

Nice. I feel like my scrap buyers would point to the " not responsible for damage to property or people

And also, dont let anyone make you feel down or wrong for being you. I have more issues than just aspergers...I am sociopathic and MDD, its life dude, just do you. No need to explain yourself to ANYBODY

Don’t need to explain anything on the internet. It could’ve really hurt or killed you if it happened differently. Glad you’re ok, and the truck is getting fixed. Aspergers or not, that would be the likely reaction many people would have when a large pipe just damaged your vehicle.

I know what a sociopath is (Sometimes us Aspies get mistaken for psychopaths/sociopaths due to our indifferent responses to certain situations), but what is MDD?!?!

My therapist, after watching the dashcam footage during our last session, said the same thing; He said it wasn't an "Aspergers thing" or "even a 'Charlie' thing", and basically a "You just dropped a pipe on my truck; What gives?!?!" thing and that just about anyone would react the same way!

An online buddy of mine on TacomaWorld was talking about how a lot of these scrapyards are fronts for the mafia; I highly doubt this one is, but in Philly it's probably still true, and places like this are where a lot of rats "disappear" to...

I don't care which organized crime operation may or may not be running various scrapyards; I am not using my truck for scrap runs ever again because I don't want to go through this shit again!

You forgot 150's 250's 350's so on and so on. The only ford I desire and would ever consider is a 64/1/2 mustang, along with an original bronco. end of story....
