Sell it to the dealer down the street for a potential profit given used prices these days.

Then get in line for a new one.

I get where your coming from. But I'm not going to fix something I DID NOT DO!!!! I have the money if I have a case to pay for an attorney. I'll take them to small claims court if I have to.....trying to keep a cool head I'm going to talk to then today. And I'll bring the truck in today. We will see what happens when we get to that point.

Keeping a cool head would be a good idea if you want something from them, as it is likely that you do not have a case.
Also you should probably not buy used cars in the future.
That's all I'll say and just wish you good luck again.:canada:

Maybe after you pay the attorney he will get through to you that YOU have the burden of PROVING YOUR CASE!

“I didn’t do it” is the defense the dealer will use to win.

Man, I would be pissed. Feel your pain.

You should take some ownership in this as well. Guessed you missed this on your inspection prior to purchase as well?

I had a warranty issue with a Dodge and the cummins diesel. The dealership totally failed and admitted it, paid for the parts and labor for a private mechanic to fix. Then they voided my motor warranty. I went in fists swinging, threatening lawyers, everything in the book. Dodge told me to piss up a rope, have fun suing, they have more lawyers and money. See you in 8 years and you will lose. I started doing some research on this and I would have spent a shitload of money for nothing.

My advice is go in with an open mind and see what you can get from the dealership. They might pay half or all. I can guarantee that if you start with demands and threats you might as well go sit on a porcupine. That will get more accomplished.

PDR might be able to get the dent out and sealed up for you. Could only be a little cost.

Next time, I would get a 3rd party inspection and inspect the truck yourself a lot better than you did. I worked at a Toyota dealership for a couple years. New or used....better look over it in the daylight very good. Put yourself in their shoes. Would you believe every swinging dick that claims they didn't do damage after months of ownership?

FYI, neither party can bring a lawyer to small claims court in Washington state. You will have to file a suit and start spending the big bucks.

Suing is generally a fools game. The attorneys all get paid, and you’ll likely get nothing but stress. They have the money for flesh eating attorneys and you have no proof of anything. If you’re nice about it they might help you out.

You catch more flies with honey, than vinegar. My wife, family, and friends are always amazed at what I can get companies to do for me, or give to me to keep me happy; and the trick is always to be calm, friendly, understanding, but persistent.

Like most say, take a breath and go in with a cool head, the dealer obliviously is trying avoid responsibility, but I really don't think that's a camper, any in bed camper would destroy the shark fin before putting the dent.

It's possible something hit the sharkfin and made it loose, it's a small repair to regasket the area but annoying as you need to remove headliner.

I definitely hear you on leaks, it was a huge issue on the new Ram 1500, I didn't experience it, but when it rains I would monitor my headliner like a hawk.

If anyone would know this...it would be you. :anonymous:

Hell, at least in Colorado you don't even go to court. The parties are assigned a mediator. Good flippen luck.

It's like kicking your own ass with both legs tied together.

You probably have an arbitration clause in your sales contract. Usually the dealer/manufacturer pays for the arbitration (varies by state to state and contract to contract). This is your real recourse if you choose to pursue it.

Does certification say anything related to body damage in the certification paperwork? I don't believe it does. If not, my guess is the arbitrator will rule in Toyota's favor.

This "deformation" is all but invisible unless you are on a ladder. It can easily be sealed so as to prevent a leak. As other suggested a paint-less dent repair will get it corrected. Probably what the dealer would use. I am glad to see I am not the only "nut" out there. I have won/settled 6 small claims. In Texas its $119 to file small claims, problem is you have no proof you didn't do it. The good news is the dealer wants nothing to do with small claims court but when you signed your sales documents I am sure you signed a document saying arbitration is your only option or something to that. Small claims isn't even an option for you, you can sue but they will return the letter of demand with the document you signed agreeing to arbitration.

Ok lets get productive, I not sure you are happy with the truck with or without the dent and that's fine. You can sell for what you paid and in worse case scenario loose a couple grand. I wouldn't blow my wad on this piddly shit. I don't sue for a $150 dentless repair that I cant prove who did it and in the end doesn't affect value of the truck.

    This is true.

Contrast: Kelly Bundy teaches us that if you pull the fly's wings off that they'll eat whatever you give them. That is more of a Teddy Roosevelt tack, speak softly and carry an 88mm PAK.

I would try escalating, but keep it kind and professional. Not the "you sold me this crap", but more "I bought from you because I trusted I was getting a well inspected vehicle. Some damage was missed which will cause further damage if not addressed, what can you do to help me out?"

It would be different if it were a dent on the tailgate, or a door ding. The only thing that may help is the angle that the damage will become worse.

When I bought my used truck the dealership guys were in awe. I crawled under it, started grabbing parts and yanking them, jumped in the bed to examine the roof and 3rd brake light, grabbed tires to wobble them and look for play, spent 10 minutes going over the engine bay and sniffing the fluid. When I was done I told the salesman that selling trucks may be a daily thing for him but something I will keep for years. Then I told them the fog light is out and has moisture in it, and that damn XM radio hockey puck needs to come off the roof.
