    While I’ve never been a patrolman, I thought they went to school or training to investigate TAs. It should be the cop who determines who is at fault as they are a neutral 3rd party with no financial stake in the accident. Whether they are investigating a fender bender or a traffic death, they should be the ones completing a report with the final determination.

    Like someone said, how many cops are at the scene of the accident. Just like how many cops are at a burglary or a sexual assault? But they will have a report stating who the subject was and the determination, then it’s up to the court on what to do. If the insurance company is the court, they shouldn’t change who the subject and victim are.

    Update.

    I got my car back today. USAA paid for the repairs and the other guy 100% is at fault. Which is how it should have been from the get go.

    Not sure in your case, but the last time I got a lawyer for this kinda thing, I was able to recoup my legal fees. The insurance paid out a certain amount for my car, my therapy and legal fees. I ended up with a check for pain and suffering. No legal bill at the end.

    I’d be surprised if the lawyer had to do much more than write a letter on their company letterhead to tell the insurance company to pull their head out of their ass.
