Well Sunday was rather interesting I drove off from a stop light and looked out my driver side mirror as I was accelerating away from the light and watched a nice long stream of white smoke come pouring out of the left hand exhaust tip. The cylinder head gasket has taken a dump, or worse a cracked head or block. I will be taking her in this Saturday and dropping her off. I am hoping it is just a head gasket.

Did you check the oil to see what it looks like?

It’ll look milky if it’s a head gasket.

    Antifreeze is a sweeter smell

If OP is FFV, ECU may just need an update.

    I didn’t see OP was SC’d
Is it Magunson? Good luck with Toyota. Been there done that if that’s the case.

I beleive he SC when he first purchased his tow truck.

Hope he doesn’t have the same issues as you did Sean, that wasn’t fun for you.

That’s not cool. If I remember correctly, this is your tow rig to take the Vector to car shows? I remember you having a C6 and Porsche for racing/fun.

Either way, glad you have a warranty.

That stinks. Please let us know the outcome. Might want to feed it the beans a few times to help make it easily diagnosed.

Yeah, oil is clean and free from any antifreeze. It will only blow by under load, normal driving and nothing seems to be passing tbrough. But if I get on it it pushes through the gasket. I will let everyone know what the outcome is.

Dont be nervous to SC. This is a gasket failure. it would have let loose with or without the SC. Toyota provided a full warranty if you had the platinum plan on your non FFV SC'ed Tundra it was covered for the 100,000 miles. So gasket failure is not a common occourance with SC'ed engines. Also Toyota uses the same head gasket for the FFV as they do the Non FFV so under Magnuson Moss they would have to prove that the SC caused the gasket failure, and the gasket did not fail on its own. Then the argument would come in to play as to why they would cover the head gasket failure on a non-FFV but it would not be covered on a FFV as it is the same part number performing the exact same function. So I am not concerned about that.

really? This is speculative at best. There is nothing to back this up.

Do you know this works? You are the one who has to prove your modification did not cause the failure, the onus is on you, not the dealer.
You are crazy to think a super charger does not put added stress on a head gasket. Add in aftermarket tune, the dealer could hang their hat on that alone and hand you the bill. I would prepare to be on the hook for this repair.

as an aside, i thought this was the toyota SC on this vehicle? I was under the impression the toyota one carried the warranty.

Apparently you have never read Magnuson Moss. I have worked in the Auto Industry my entire life. The Onus is on the manufacturer to prove that the failure was caused by the modifications made to the vehicle. If you were taken to the cleaners by a dealer than you needed a better lawyer. Yours apparently did not understand the law. Magnuson Moss was written to protect the little guy and prevent him from being bullied and taken advantage of by the auto manufacturers.

The MagnusonMoss Warranty Act (P.L. 93-637) is a United States federal law (15 U.S.C. § 2301 et seq.). Enacted in 1975, the federal statute governs warranties on consumer products. ... The law was created to fix problems as a result of manufacturers using disclaimers on warranties in an unfair or misleading manner.

What will void the warranty on a car?
Although car enthusiasts commonly believe that any modifications will void a warranty, the truth is a little less straightforward. In fact, a modification won't void a warranty unless an automaker or a dealer can prove that an aftermarket part caused the need for repairs.

In my case there are no aftermarket parts on my truck. The Blower and fit kit are not Magnuson, they are TRD. I am using a Bullydog Flash, but it is based off the same flash that Magnuson provided to Toyota for the TRD supplied blower by Magnuson. Which Toyota would cover under warranty if it was not a FFV. So now they have to prove that the same head gasket in a FFV wont survive being supercharged. Also I could put the dealer in a very precarious position if I wanted to. My dealer installed the SC on a FFV. They did not make me sign any waivers and they did not recommend against doing it. They were more than happy to install the SC on my vehicle. So I could technically sue them. It wont ever come to that. They are good about servicing my truck and they understand the law.

I'm not an attorney, no lawyers or repairs needed here. but anyways, the dealer could hang their hat on the aftermarket tune alone and call it done. To say "the supercharger has nothing to do with the failure" is foolish.

Ok so the dealer states the cause of the failure, and they offer "proof". You will still bear the burden of proving them wrong.

Yes but being an ASE certified Master Mechanic, an Engineer and Engineering Manager who has worked for OEM's and Tier 1's for over 31 years, I stand on pretty firm ground as I will require them to show me a vehicle with the same set up that has failed. This will mean that the dealer and Toyota will have to prove beyond a shadow of a doubt that the Bullydog Tune is the cause of the failure. They would have to put it in a lab and test to failure. Then provide the court with documented proof of the failure.

If you are going to play in this arena then you need to know how to stand up to the big dogs. I come a little better equipped to fight the fight, but it will never get to that. If it does I have no problem going toe to toe in court. I spent several years as an automotive expert witness testifying in court for lawyers.

@ColoradoTJ sorry there's no smacking here bud.

While W8 is prob better prepared for this than anyone else, he is still on the hook to defend his case. The same resources the dealer would use, he would be in a similar position to counter their argument. It adds up fast, and toyota has bigger pockets. I hope this works out in W8's favor. It's not like he put on junk, or sketchy parts but these are the risks we incur doing stuff to our cars.

I would be surprised if Toyota warranties the BD tune, where BD claims is the same tune as TRD or not.
