What are the laws concerning purchasing a gun privately? Does the gun have to be registered to the new owner? I’m in the states five months of the year and I know that as a Canadian I can’t own or possess a gun but the 85 year old grandma just across the street at our Florida home packs a 45.

    It varies state to state.

In AZ, there is no such requirement to register weapons. Federal background checks are only required when purchasing from a licensed dealer.

When two private parties come together (neither licensed dealers) they can buy/sell/trade firearms with no registration and no background check. That is what is referred to as the “gun show loophole”.

Couldn't tell ya, AZ is kinda wild with "constitutional carry" though, no permit needed to conceal carry.

Looking to sell a gun this weekend. In AZ, there is no background check for private sales.

I've sold a couple in the past: I typically ask to meet at a neutral, safe, location (never at my home). I ask to see their DL to verify ID, residency and age. Otherwise as long as there are no "red flags" that give me reason to think something is sketchy it's that simple here. A Bill of Sale is optional, but not required.

Enough is enough. I have a 01 StarCraft camper for sale, ask for pics if you are interested and I got you. It's in decent shape for what it is, I don't need to get rich off the thing, wel exchange pics or whatever and you can make an offer. I'm fuckin over it with all of this.
Truck is negotiable also. Just ask anything you wanna know if you are interested.

Most states are Constitutional Carry states. It's not uncommon at all.

As others said, it depends on the state and it's individual requirements. Firearms do not have to be registered in free states, and you are free to sell a firearm privately without a background check. You cannot knowingly sell to someone that isn't allowed to possess a firearm, though.

I guess I thought it was less common because I've only ever carried here and in Colorado where it's a little more strict

Florida is kinda wack from what I understand, open carry only when hunting or fishing. Then you get asshammers like "the armed fisherman" who carry a pole and a rifle just to make a scene.

So the onus is on the seller make sure the buyer can actually legally have a firearm? Personally I would be very nervous selling privately then find out I could be in hot water because the buyer wasn’t suppose to have a gun.

In Canada I can sell my firearms privately but the buyer has to show he can legally buy a firearm. We have to carry a picture ID card that looks like a drivers license. I recently had to sell four guns but was nervous about fake IDs and ended up selling them to a good friend of mine who wanted to add to his collection. If he didn’t buy them I would have likely sawed them in half and throw them in a deep part of the lake.

No. You can't knowingly do it. If you have no idea, then there is no onus on you as the seller. If you didn't know Jim Bob Joe buying your rifle was not allowed to own one, you are not in trouble. It's if you KNOWINGLY sell to some one that can't have it.

Got real lucky so far and have had a charge dropped and another lowered to misdemeanor. Haven't lost them rights yet.

For those that require a permit to have a firearm, is it a photo ID like we need in Canada? Is a permit required for all firearms or just handguns?

Looks like a DL. Says conceal carry permit. Even though AZ is constitutional I still have a CCW, it shows that I am a little more responsible and educated than people who don't. Figure if I ever have to actually shoot someone everything I can get in my favor helps

So no permit required for a long gun? So permit if you conceal but do you need a permit if it’s open carry?

Not required for open carry or conceal in constitutional carry states. No permit for long gun, and can buy em at 18 instead of 21. Having the permit is cheap insurance, it basically says "I know what im doing"

The way it was explained to me is basically "ask yourself 2 questions, if you answer yes you are justified in lethal force"
    1. Is my life or the life another person in immediate danger
    2. Is a felony being committed against myself or against another person
You can shoot someone to stop either of those things

There is no onus. As stated - they just can’t knowingly sell to a prohibited possessor. They aren’t required or expected to do any sort of investigation into the buyer.

Never a permit for any fashion of carry in AZ. Open, concealed; handgun, long gun doesn’t matter.

The part that kinda annoys me is the drug technicality. Marijuana is legal but for the love of shit don't carry a joint and a gun at the same time.
But I could be hammered in the bar with it on my hip, no problemo. Kinda dumb imo

How does that work exactly? I'm sure the seller isn't going to roll up and go "by the way, I'm on parole for armed robbery."

    Another example.
MN is a Permit Required state.

No permit required for long guns.
The permit is to CARRY, not to OWN a handgun. MN does not make a distinction between concealed or open carry. If you have a permit to carry, you can legally do either. I can count on one hand the number of open carriers I've seen in the 7 county metro area over many years.
Anyone can own many handguns. Just cannot carry it on your person or in a vehicle without a permit to carry.

The permit is a Concealed Carry Permit, and even states that don't have it as a requirement it is offered and can make carrying easier in some instances. It is a permit to conceal carry, so it only applies to handguns.

Here is a snip of the google results for what they look like. Appearance and requirements to obtain them vary by state.

It’s confusing from my prospective on this side of the border. There are permits required to conceal but nothing required to open carry and only in some states? If I cover my handgun it’s considered “concealed” and “open carry” would be that it’s visible all the time? I’d be a littler nervous having a gun hanging off my hip and walking into a store.

Seriously? No problem being drunk and visibly armed? Not where I live.
