Let’s say - hypothetically he was in an accident that was at least partially caused by being overloaded. Hypothetically an injured party from the collision hires a lawyer. Hypothetically the lawyer deposes OP and asks if he posts on any internet forums. Hypothetically the lawyer finds the posts showing that OP knew or should have known he was towing a trailer well beyond Toyota’s specifications. Hypothetically the injured party could then assert a legal claim for punitive damages based upon OP’s decision to ignore the known risk and making a conscious decision to ignore the guidance of the manufacturer thereby putting others at risk of serious harm or death.

These types of damages are almost never covered by insurance but the insurance would still be on the hook for the injured parties property damage, medical expenses, lost wages, pain and suffering etc.

I’m not a lawyer and don’t claim to know laws in ever state. But NH and the surrounding states I’m apt to drive in clearly differentiate the .04 limit to while operating a commercial vehicle. I don’t drink so doesn’t matter to me. But a non commercial vehicle is .08 like everyone else.

Yup - sketchy part comes in vehicles that are under 26,001 but are still DOT / state registered commercial use - is that a commercial vehicle? In other words an F250 / Tundra or even car could be argued to be a commercial vehicle depending on registration…

 

You know what I think? I think it's bullshit that passengers and fuel count against payload. It's a damn truck! Payload should be what you can haul in the bed after you've filled the tank with gas and all your fat ass friends have piled in for the trip. In that regard, I think 1200lbs for the Tundra sounds like a reasonable expectation.

If you're taking Hwy 1 this year (and next for that matter) at the bottom of Kicking Horse Pass there's major construction that starts at the bottom of the hill - which is 6 km of ~6% IIRC; and the construction lineup backs up onto the downhill part of the hill. Pretty important on that hill to be under control at 80 km/h for all vehicles once you pass the rest stop at the bottom. Definitely a good test of the braking power there.

I think this is where I differ from what most of the forum. My understanding is that the insurance company can deny the claim only if they can show that you intentionally caused the accident. Simply showing that you were aware that your truck was a bit (or a lot) over payload is not enough. They have to cover you up to the limits of your coverage even if you were driving in a grossly negligent manner. What they don’t have to cover are intentional acts made to look like accidents. That is insurance fraud, and it is more common than you might think.

Knowing you’re a bit over payload and knowingly causing an accident are two COMPLETELY different things.

The tundra rear bearings are very light compared to the brakes and the 10" diffy.

It's bothered me that Toyota spent so much time engineering the brakes and diffy, but completely eased their hands of those wheel bearings.

On the plus side, they are easy to change.

 

Maybe it varies by state, but as far as I know it doesn't and it is in ANY vehicle at any time. I have a CDL and my DUI limit is half the legal limit regardless of what I am driving, on or off the clock.

 

Sure, they could do that, but Toyota would just put a sticker in stating the payload was 600 lbs less than current to cover for the passengers. Weight is weight, regardless of source.

 

The housings are light also. Be surprised how many are bent, if it has been used hard/towed heavy frequently good chance it’s bent. Bends between the spring perch and wheel, then the bearings become consumables. Only seen one actually break though.

Full tank of gas, yes, that should be included in the curb weight. Driver, no, you're thinking of the towing capacity.

I thought when I had my CDL in Ohio that I was held to the higher standard (lower BAC number) regardless of what I was driving. May be wrong on that. I do know that a LEO seemed to be a little more lenient with speed limits when I had the CDL. Once 12 over and once 13 over in a 55 zone got me nothing more than a verbal warning. Don't get your panties in a wad. I wasn't towing at the time.

 

Payload = gross weight - curb weight

Also, notice the language on the door jamb: “Occupants and cargo should not exceed…” Driver is an occupant and is not included in the curb weight.

Curb weight is bone stock truck with all fluids filled (including the gas tank). This is why the bigger fuel tank counts more against payload. They’re accounting for 11.6 more gallons of fuel.
