Does anybody exceed payload when towing?

Dont necessarily disagree with anything you wrote. Link 2 comment - secondary offence they could ask. I highly doubt they will use weights as a primary for traffic stop.

Waiting for inventory to ramp back up and will get into a RAM 3500 HO SRW within the next year or two.

 

I've seen portable scales set up but the only trucks they were weighing were 18 wheelers.

Bottom line is this... Regardless of how it drives, feels, sags, etc... It doesn't matter what a group of internet attorneys give you a 'blessing' to do when you're in an accident w/whatever setup and someone is seriously hurt or killed. At that point, other than your BAC, the next biggest concern for whoever is doing the investigation is payload, GCWR, TWR, etc. It doesn't matter if you're running airbags, improved suspension, etc. The ratings are the ratings, and if you are exceeding them you will incur liabilities that you may not have otherwise had in the incident. Additionally, numerous jurisdictions/DAs will consider running the circumstances by a grand jury to determine if criminal charges should be filed in the event of death or serious injury, including negligent vehicular homicide/manslaughter, negligence resulting in the death or serious injury of another, etc... (all of that depends on the jurisdiction which the incident occurred). Even if you're able to skate the criminal charge, once the investigation turns that direction your expenses for legal defense and subsequent civil litigation can get sideways on you real quick; not to mention the civil liability that will surely land in your lap.


Just food for thought... But, if my truck didn't meet my needs, I'd get a different truck. To me, it's not worth risking financial well being or the physical well being of my family and I.

 

Actually, it happens fairly often... Investigators don't need to do it w/the exact truck and trailer if they are wrecked beyond use. But instead will find a truck w/duplicate specs and ratings to 'borrow'. They will then find a duplicate trailer that matches specs to the subject trailer and attach it to the truck in the same fashion as the subject truck. From there they will load w/equipment, etc and re-create (as close as possible) the circumstance at the time of incident and acquire CVWR, payload, tongue weight, etc. to use in the investigation.

I have moved my pop up Aliner trailer with my electric Ryobi mower. The trailer is about 2000 lbs…. But only 50 ft and sloooow. I also moved my portable backhoe with it, at 1200 lbs. at my new home I have more slope to the land so I’m buying a Honda ATV, 4x4 Rancher, for moving my backhoe. I’m afraid the trans will die on my Ryobi and just get stuck as it’s only 2 wheel drive. If the ground was more solid I’d use the tundra.

 

Insurance companies are like Casino's, they aren't in it to loose. So if anyone thinks an Insurance company isn't going to do their due diligence and investigate and investigate to not pay on a claim caused by negligence, well you can try it and see how it goes.

 

So they are required by law to cover you if you cause an accident while intoxicated, while driving reckless, while speeding, but not if your trailer puts your truck over payload?

When did I say that ? In the end, they will do whatever necessary to not pay , and if they do, they will recoup in one way or another.

 

It seems that you were suggesting insurance companies can get out of paying a claim due to negligence. But negligence behind the wheel is exactly why auto insurance exists. I linked an article a couple of posts above yours showing why insurance companies are required to pay for your illegal acts.

This whole idea of an insurance claim denial as it relates to a half-ton’s door jamb numbers just seems like a particularly strong specimen of internet lore.

 

There is a difference between being illegal and being sued in civil court if you were in a wreck and someone else was injured. Insurance only covers so much regarding medical bills and death gratuities. Burden of proof is a lot lower for civil court.

Do I have any examples? No and I’m going to waste time looking for any. But there are a lot of sue happy lawyers out there.

 

Yes, they cover up to the coverage you pay for. Just like when you get into any accident for any reason. Agreed that lawyers are out there to make money.

It’s just funny how people will speed all day long and not worry about being sued in civil court for reckless driving if they get into an accident while speeding, but man if you hook up a trailer that puts your truck 200lb over GVWR, look out—everyone is going to come out of the woodwork and shame you as they drive by doing 15mph over the posted limit.

And helping pull a crushed 8 year old out of a vehicle hit by an overloaded 1/2 ton truck pulling a cargo trailer sucks even more. One of the reasons I'm rather radical about staying within the given tolerances of a vehicle. I worked several other accidents in my career that an overloaded vehicle was the cause of, but the 8 year old was the one that hit hardest.

 

I always end up over on the weight limits, i got sick of it and just started using a car transport company to handle this
