    If they do not total it then be sure to go after them for diminished value for being a wrecked vehicle. Also be sure to watch your son and yourself even if you think you are both OK. Health problems and injuries can sometimes hide and not be detected until later. Make sure you are OK and made whole before signing off on any type of settlement.

    Glad you and your son are ok. If it gets fixed, fight for diminished value. I've won against the insurance companies on this, so it's possible. Also, get medical attention regardless. Lawyer up for the personal injury portion of this accident anyway.

    Sorry for the delay. The truck is totaled. The frame was bent pretty good and they couldn’t get a new one anytime soon. The annoying part is that I told them from day one they need to look at the frame. Caliber decided to fix everything else they could before they put it in the frame rack. So it wasn’t totaled till last week. Now I’m fighting with them about all the parts on the truck. I sent them 15k in receipts. I’m pretty bummed as I had a lot of time and money into the truck and it’s all gone now and I have to start from scratch. The positive is that my dad works at a Toyota dealership so I have confirmed I can get a 2022 at msrp or less. Looking at a 1794 TRD off road or possibly waiting to see what a TRD pro will cost.

    That sucks man. Saw it coming though. At least they didn't try to do some shitty "repair" to the frame and call it good. As for being out the money for your mods, I know the pain. Totaled my diesel back in 2005 that I'd sunk A LOT of money into. Never got a penny of it back. Now I'm pretty much of the mindset that you should buy the top of the line trim you can afford and try to avoid sinking too much into mods.

    Oh they tried lol. At first they tried for two days to bend it back and then tried to use some random frame they had sitting around from an unknown spec 2015. And yeah that’s why I’m thinking wait for the pro might be the best bet for that exact reason.

    Why will they not let you keep your mods? I would have taken them off before they took it, like I did with the Jeep my wife totalled.

    In theory, that may work. In reality, it usually isn't practical. Usually your wrecked truck will be parked in some remote tow yard and spending hours there to remove accessories attached to a totaled truck is usually more trouble than it's worth, especially with everything else you'll have going on. With my truck, I had replacement bumpers, running boards, etc. The truck was basically sitting on its frame from the wreck and getting that stuff off it in the condition it was in would have been challenging in a shop setting with full tools, much less in a gravel tow yard.

    I may be able to for some but I’d rather them just pay. Nothing is going to work on the new truck anyway. Plus I can’t pull the wheels and suspension off and leave it sitting on the frame.

    Ok, my wife's Jeep was towed home and the insurance adjuster came and took pics. I tore those mods off before they came to towed it from my house.

    Insure your mods fellas. Typically, insurance companies will ask you if there are modifications on the car that you want to add. It doesn’t cost a lot. There is a limit though.
    If there’s 15k in mods for example, you can do agreed upon replacement value type insurance instead of “cash” value. Get it from a specialty insurer.

    If my 05 got totaled, cash value is probably like 12k. But it would easily cost me around 60k to duplicate it.

    It may be a tough case if your insurance company wasn’t notified of the aftermarket parts prior to the accident. This is just based off of my own research. I’m not a lawyer or an insurance agent. Everything I’ve read up on says they are only obligated to cover the cash value of the car and that they could cover up to $4000 of aftermarket parts for example, but they have to know about them so they can make the their adjustments to the premium, with both sides agreeing.

    It’s on the CarFax, but still shady.

    This is why I always ask for a carfax, and do a third party inspection on any vehicle I purchase…even new. I’ve seen what goes on at dealerships.

    I used to take the train to Chicago and back for work for years. We would pass by the new car yard in the West Chicago train yard that stores a lot of manufacturers cars/trucks/SUV’s. You’d be amazed to see how many damaged cars there are from the drivers taking it off the trains and putting them on trucks. Some look like they literally fell off the ramp coming off the top level of the train. Most of the time the accidents don’t even show up on the Carfax and Dealers don’t have to tell you.
