It’s not the police that don’t do anything it’s our terrible court/jail system. I see day in and day out the carnage caused by DUI drivers and most the time they’re out before I come in for my next shift.

Can pull more than the mirrors. 3 other good wheels, rear sway bar, exhaust, grill and hood bulge, fog lights seem good, trd shifter, trd door panels, trd passenger dash cover, antenna, under seat storage, floor mats, trd air filter, center console organization.

I'm telling you get an attorney. It wasn't your fault you won't even have to pay them up front and you will come out much further ahead

Bullshit. I have had two uninsured drivers smack into me. After the fks present an expired or not valid insurance policy to the simple Simons and the simple simons buy off on it I then find out form their insurance company they did not have coverage. I go to the police station with proof from the dirty cnts insurance indicating they did not have insurance at time of accident. One illegal got it 40 minutes after the wreck. Simple simons do nothing, tell me my uninsured motorist will cover it. I tell them do their fking job and issue citations which they dont but they get to listen to rant. No worries I then file small claims with diminished value included and win. When the dirty cnts dont pay no worries, liens are filed. Liens lay out their like cancer until you try to purchase something and BINGO. I am always very hard to deal with when the title company or bank wants to close the lien. funny how that works.....

Police do nothing and when they do they service the wrong entity.

Of course to do this he will have to negotiate with the insurance company to keep the crashed vehicle, which would obviously reduce the cash he gets from them.

The thing is.. I have all the stock parts for everything I added. So if they are going to give me a stock price, I'll give them a stock truck. But we'll see what happens when they give me an amount and if I need to get a lawyer. I'm not going to get screwed on this because of someone else's fault.

Unless you have the crashed truck in your possession right now, I wish you the best of luck. Having dealt with trying to get access to MY car that was in custody of a towing company to retrieve something I left in the car, unless your a friend of the towing company, I doubt they will let you show up with a truck load of parts to swap out. Same if it has been hauled to a salvage yard already. That salvage yard owner is looking looking to sell those parts on your crashed truck...or maybe the entire truck for somebody to fix up on the cheap. As for getting a lawyer...you are talking about a <$20k truck? I just don't see that as cost effective in order to try to get a couple thousand more out of an insurance company. I am new to this forum and not trying to be a downer. Just trying to share some of my experiences. I won't get into another one that involved another total loss of a brand new car. Bottom line is in spite of all the do this and do that talk you are going to lose some in this situation. Part of the reason is because we all over-value our own vehicles..that is just human nature. Second is the insurance company, especial if they are not paying for a rental vehicle for you or storage on your crashed truck (likely already moved to a salvage yard so probably not) will be in less of a hurry than you, so they will likely wear you out and you will throw in the towel and compromise just to get it over with and move on. Again on the bright side..you survived.

@LuvTundras if the guy was lit when he hit him, the settlement is going to be much more than the value of the truck. Lawyer won't be an issue. Also nearly all accident attorneys have free consultation to tell you if its worth it. I guarantee you they will more than enough to cover the fee after the fact. Many times accidents involving impaired drivers will end up much more than vehicle value.

Totally get what your saying, BUT... My truck is currently at the body shop that my father-in-law worked at for 50 years. So he knows people there and it wont be a problem at all to go get all my stuff before they move it. I do agree about the insurance company trying to low ball and all that. I know a few high power lawyers in town that I can probably get one to make a phone call for me. I doubt it would take much more than that to get them to get it going when the time comes. I will probably loose out on a little, but trying to make the best of it all. I know what the truck is worth and what I had in it so we'll see. But yes, I am totally ready to get all this shit behind me and into a new truck, and yes, more than happy we survived.

Man reading this thread and responses gives me bad memories of my truck getting hit and the process of that ordeal... still gives me heartburn. I don't envy you man. Good luck will all this and hopefully it's over soon and try and remember through all the dumb crap that the most important thing is you and your fam is ok. After the dust settles and you're neck deep in all the insurance bs , it's easy to forget about that part.

@TTU19 one thing I can say you're lucky for is that it didn't happen 1000 miles and four states away from home. Mine did and it took me a month just to get my truck back to my home state before they could start fixing it.

Oh yea. Luckily my damage wasn't all that horrible as my truck was hit by an rv while it was parked so it just ripped the front off essentially but state farm wanted me to drive it home from Texas to Utah with the damaged parts removed....... I told them where they could shove that and left it in texas and took their rental home to utah to force their hand. Took a month of back and forth and the phrase I kept using that they couldn't argue was " I wouldn't be in this situation if your client wasnt an idiot so figure it out" anytime they wanted me to do something I just told them no. You have all the leverage because their client was at fault so they know they're on the hook. Just stand your ground on everything

Yeah, I plan to do that if the time ever comes. They are dragging their feet and are still at the "getting the police report" part. Luckily USAA is doing a good job so far on my end then I guess go after them. It's all a mess, but at least it's starting to somewhat work itself out. Now just ready for my new truck to come in.

Ok, so it's a total loss and finally got a settlement number back. I'm looking at 28K. In all honestly, I think it's a pretty strong number and I figured they'd come back much lower. I wish I could get a couple grand more out of it with everything I've done to it, but I am going to be taking most of that stuff off, so not bad I guess. Probably not worth going through a lawyer and possible court for a couple grand.

They said they will only really consider parts that I've added in the past year and not a dollar for dollar match. Kind of sucks though to put so much into it, just for some asshole to come along and take it all away.

Will you be able to take off all the parts you have added and not just the parts from the last year?

Thanks for posting this thread, it motivated me to add a camera to my truck. Glad you and your wife are good and that things are getting worked out with the truck.

I'm taking everything off that I have a factory part to replace it with, which is everything. Only thing I can't take off is the leather I added day 1 and the lift.

Ha naw.. not going to deal with all that. Leather was in good shape, but had some wear from being 5 years old. Looking forward to new leather and a different design in the new truck.

You're absolutely in the right to replace your upgrades with the original stock parts. My daughters Tacoma got totaled a few months back and I swung into action getting the TRD wheels and BFG tires off that I bought her for her birthday. I also grabbed the shifter knob and she keeps it on her shelf as a reminder. Glad you and the wifey are OK. That's what really matters.

You would throw that dang pokes in there, haha. J/k. Yeah, I'm going to be stripping it down on Sat. My father in law worked at that body shop his whole live so a guy there is helping me get it all off and set back up. Some of the parts I can use again and some I'll probably just sell to some local guys who may need them.

Glad you got it taken care of by insurance. Bad part is finding a replacement Tundra.

My wife was hit the other day and I’m doing the same thing dealing with the other drivers insurance is a PITA. I may just eat the deductible and go through my insurance. I need to make sure my rates aren’t going to be affected.
