Im having Finance department issues where I purchased a vehicle

    He said it already, credit union. He goes thru a credit union.

    The dealer can call all they want, but in my experience the credit unions will only talk to their members about these things and no one else. I just went thru this not even a week ago trading in my 12 for my 20. The credit union wouldn't talk to the dealer about my financials with my 12, only me since it's my loan. I got the 10 day pay off amount which ironically enough was pretty close to yours, and I wrote it down 3 times on one slip of paper and handed it to my salesman who took it to the finance manager. When signing everything I also double checked all the numbers with the finance manager and my salesman as we went along to verify there was no transposing or fat fingerings in the paperwork. I've had bad experiences with contracts in the past at smaller dealerships where they've tried to put in less for my trade than what was agreed upon, and I've caught them and walked away. So now I'm always on my toes tho my yota dealer would never ever do that.

    My opinion, see if theyll meet you half way on it ($175 is pocket lint to a dealer) or just suck it up and pay out the $350. It's kinda both of your faults from what it sounds like....not trying to be a dick...

    I did not take the statement of payoff with me when we signed over the paperwork. I did not have it memorized. But lesson learned. If I buy another truck....lol.

    Be thankful in the end, it's only 350 bucks. When I bought my 12 we agreed that we would meet halfway on installing remote start in it at a 650 price tag, so 325 each, no big deal. After hours of hmm'ing and haaa'ing that night we closed the deal but I forgot to tell my credit union to add the 325 on my loan....crap happens lol.

    I'm fortunate to have the best yota dealer in the US (for sales at least in my opinion) 5 min away from me and will let me bend them around a lil when things go sideways lol

    They took possession of your trade-in and signed a contract which you also signed (a binding agreement for both parties). Now, you have that contract with the exact numbers on it. Highly unlikely any court would back their argument.

    I'd tell them to have a nice day.

    Usually a dealer asks the current lien holder for a 30 day payoff. It sounds like the dealer made the mistake possibly.

    Except OP signed a contract with the wrong payoff amount. Mutual mistake is typically grounds for rescinding or voiding a contract. They could also allege fraud... not saying that will happen but it is not as simple as “not OP’s problem.”

    That’s not exactly true. The dealer’s finance department is acting on behalf of lenders. They get paid a nice sum of money for selling the loans, which is why dealers will often meet a credit union’s advertised rate. It usually costs a bit of the total money they receive for writing the loan (they buy down those percentage points) but there is still more profit in writing the loan in house than letting it go to a credit union in most cases. The lender is paying the dealer for their financing department / notary services / etc so having the right numbers on the contract you sign with the lender is 100% the dealer’s responsibility. If you showed up with credit union financing, the credit union is responsible for developing the contract. You as the consumer just sign it, you can’t make material changes to the contract. The terms and conditions are set by the lender. A part of every deal is that the dealer will pay off the trade in full, that’s why any money someone is “upside down” in the trade must be paid up front or rolled in to the new loan. A lien holder cannot remain on a title when a dealer sells the car in their lot or at auction. As I said, nothing wrong with the OP being reasonable, but this is 100% on the dealer. They made the mistake... and there’s probably nothing they can do at this point other than pay the difference. I don’t know why they’re threatening to have the OP carry two loans. But I don’t know the nitty gritty of the situation or specific deals outside of the ones I’ve seen.

    you think a dealership is going to chase you down and make an example out of you for $350? that would be the worst advertising they could ever have and with today's social media, they'd best eat that $350 and move on.

    Another way of looking at it is if you’re going to use that dealer for service it would be better not to piss them off since they’re the ones that can talk Toyota into warranty items of tell them not to warranty something due to negligence . Unless you have another dealer to use for service .

    Tell the dealer that if they made a mistake to send their request to change the contract to you in writing. Ask them to send a copy of the contract highlighting the areas where they believe they made the mistake and a full explanation of the numbers as to how it was a mistake. Also, have them highlight the areas in the contract that give them the right to cancel such an agreement.

    Chances are you will will never hear from them again. If you do receive such a request contact your local consumer protection attorney to see if you have a case. If, for some reason, you don’t have a case, you can always give the car back and walk away.


    Call an attorney in your state. I'd be willing to bet that you're done and need not worry about the $350 (tree fiddy).

    Yeah, I'd probably tell them to pack sand first; and in the meantime, definitely call an attorney. I've probably purchased 8-10 new vehicles and a few used from dealerships, and I have *NEVER* made a purchase involving a payoff amount without the dealership *FIRST* verifying the payoff amount. In fact, one dealership did in fact make a mistake elsewhere in the contract for a slightly larger amount, and they ate the difference.

    So i talked to them today and he said he don't think he made the mistake. So we went back and forth for a while and he said even if he made the mistake it is still my job to pay. I said this no it is not because you told me this was my down payment and you guys would take care of the rest and that what we agreed on. After we were not getting anywhere I told him well since with both made a mistake let's split it in half and his answers was no. So I then told him I was tired of him bugging me for 2 weeks that I just wanted the Avalon back and he could have the FJ cruiser back ( I was hoping and crossing my fingers he said no I don't want to give it back.....lol) so he said I can't take it back the deal and check are already funded. So he then asked me " are you going to pay it or not" I then told him NO. He said OK thanks. I will submitted to the office.

    I think they blew it. They either didn’t verify or couldn’t verify your payoff loan amount, which I find that hard to believe as it can be verified through the vin # and your finance institution. Stick to your signed paperwork.

    I’m going to refi my truck in May, I called today to my finance institution/ bank today, I had to give him a 10 digit # but I wrote it down wrong, missed a single digit. The guy I spoke to said give me your s/s # or the vehicle vin# so he could see it and give me the correct account # that I had messed up when I wrote it down.

    my point is there’s three ways of verifying how much one owes on a vehicle loan.
    It’s on them bro. Not you. I also read the article from post # 42 . You could follow that for more good info.

    Well, since they made all the future payments except the 350$. tell them you will pay it when it is due at the end of the length of the original loan. You won't be incuring any late penalties and then they can sit on your trade in because without the lean paid off your financial institution will NOT release the title. For what the payoff was you probably had about 2-3 years left on the loan, not much interest accumulates on 350$.

    So finally this is over talked to a finance buddy and told me to ignore there phone call and the dealer was eventually going to have to pay the difference. So after 2 weeks if ignoring phone calls and also got to the point where I told them to get my Avalon ready and they can keep the FJ they said negative we can't do that either. So I ignored them some more. Last night I called my bank where the loan was thru and the dealer did pay everything my balance now is actually 20. Bucks over. So I'm glad they paid for there mistake. Also wanted to post this so if you guys have similar problems you can learn from it here
