2020 Tundra Front End Collision

The IIHS testing on the small overlap is done on a solid object under very strict controls. The small overlap accident the OP had wasn't a fixed object with no controls. It's a very big assumption that the IIHS testing isn't valid based on what happened in the OP's accident.

 

Interesting on IIHS tests. Differences would be:
- Other vehicle (Honda Accord) was smaller, moved on impact, and somewhat cushioned impact, as opposed to testing with an immovable object.
- My front collision was relatively head on with the side panel door of the other vehicle, which was different from some of the offset testing I have seen on YouTube.
- Consistent with IIHS tests, Tundra driver was slightly more protected than passenger.

 

Yes - in the IIHS test the Tundra structure is working against itself. A fully outfitted Tundra probably weighs close to twice what an Accord does. Had this accident been with a 13K pound box truck, the outcome might have been different. Everyone involved was lucky and everyone is glad!

This is a pic of the Tundra after the IIHS small offset driver’s side test. Notice the difference in the suspension/tire and think of the difference in forces that it took to drive that entire tire almost in to the passenger cabin in the IIHS test vs the lesser energy in this crash with a lighter vehicle and different energy transfer in a real world accident.

That said, the Tundra crash test results when the structure was designed in 2007 were fine because they were crashed in to a barrier with the full front end. The problem is most real world accidents are like this one, offset. So the Tundra is pretty poor in the offset because the offset test didn’t exist back in 2007. I’m sure the 4th gen (new gen) will do fine in all the new tests, including headlights/offset/roof strength/etc that have been added to the IIHS safety ratings for a vehicle. I’m personally glad IIHS keeps pushing and publishing these ratings, they’re resulting in manufacturers designing safer vehicles for all of us.

Disappointing to see all the sue happy post on here. It's a disgrace to victims.

In Louisiana the lawyers will take 30-40% of a "settlement", and if all your medical claims are legitimate then you left holding the bag with bills to pay after the lawyer takes his off the top. It also takes years to see any money. Lawyers are scum!

It's likely that the Allstate policy is 15/30/25 and hit it's limits with totaling the truck and USAA will have to eat some or go after the driver/owner for the amount above 25k.

The 15k per person boldly injury limit
will be quickly gobbled up with lawyer fees and bonafide medical bills. Your personal medical insurance is going to want to be paid back from Allstate.

The OP will likely not see much of anything, years of fraud and abuse have ruined the system for bonafide victims.

The TV lawyers are criminals, they get you paid if you get in a fender bender, fake an injury, and are looking for a 5-10k check.

Anyone know how to secure a TITLE for a brand new 2020 Tundra that was purchased by personal check in full on 3/9/20, wrecked on 3/28/20 with paper plates still on it, considered a total loss on 4/16, and can’t get check for total loss until title is issued? Called dealership and got all proof of purchase info, got copy of original title application submitted by dealership to county and state, called TX Dept of Motor Vehicles and they say county and state employees are not answering calls, have a big backlog of title applications, and are only working Tues and Weds due to COVID pandemic. Any other alternative options to securing the TITLE?

 

What is the normal time frame a title? In NY it's about 6 weeks.
That sucks that they don't believe that you paid for the truck, they are probably scared that they would be out the money if there was a lean on the title.

There will always be a accident on his Vehicle vin # . If there’s frame damage that info will never go away too. If it’s listed on an estimate and insurance pays out on that, the accident info will always show up on a car fax report.
My boss had a older woman driver smash his 2019 three day old Audi and he’s sold it and that accident always showed up on car fax.

 

100% this. You don't pay anything "out of pocket" for a lawyer because they take it off the settlement. USAA is a great insurance company with teams of their own lawyers. If he got some random lawyer to get the other guy to pay for medical expenses and the cost of the truck it would theoretically be $100,000. 30% fee to the lawyer would be $30,000. Medical expenses would be $50,000. That leaves $20,000 to buy a new truck.

How is that beneficial compared to letting his insurance do what he's been paying for them to do?

 

You can negotiate for diminished value which can and should cover any loss or perceived loss due to this type of "branding". It would be up to the individual to pursue this as i am not sure insurance companies readily offer this.

Side note about carfax. I bought a used Tacoma years ago that had a clean carfax. It was obvious that it had been wrecked, but i bought it anyway because it was such a good deal. Years later i totaled the truck, then bought it back from USAA after they settled the loss. I repaired the truck, then sold it a couple years later. I ran the carfax on it and it was still showing "clean" with no accident history.

 

Yes Sir I understand that what your referring to. I was on the hunt for a used truck just recently. My two choices were another Ford Lariats or Tundras. I must have looked at 200 vehicles In 5 months. That said I came across 3 vehicles that had been damaged, but not reported accidents on car fax. It wasn’t until I was going forward with bids at steelerships and disclosures came up, did my own research that I was able to find details on these “non reported accidents”. The truth is out there, you just got to dig (I grew up in a body shop.) I did not purchase any of those three trucks. I called Carfax and complained, showed then the errors on there reporting. Don’t think they liked that either...
I gave up when I found a 16 DC Tundra that finally hit all requirements. Bought it. The point here is, can you live with a vehicle that’s been in a accident and fixed, that may not bring the best resale value? Some can, some won’t as far as documentation.
I wanted to be able to show a good resale value if I ever have to sell my new/used DC. Hopefully this is the last Tundra I will buy. Getting older.

As far as the OP I’m not sure what way he’ll take and how able he’s going to keep pressure on the insurance company and body shop.
That is always an up hill battle.

Same here. I hit two cows on the interstate in Montana at 75 mph in my Dodge Cummins. Nearly totaled it. The repair was $16k. Never showed on the Carfax for some reason.

 

That's because Carfax is only as good as the info they are provided by state agencies. If there was a wreck on a vehicle, but they got a buddy to help them haul it to a body shop, and then they paid for repairs to keep insurance rates from going up.... no record in carfax. Carfax is a good place to start, but it is definitely not fool proof or all encompassing.

 

MHP investigated it, completed a crash report, and called the commercial tow/flatbed, and insurance paid everything. No reason for it not be on there.

Assuming the report got sent to the state from their traffic division and the state worker didn't miss a number on the 17dig VIN (or insurance).

 

I'm not sure what all the praise for USAA is about but they tried to, and did ultimately did, screw me over. I had USAA insurance on a Honda S2000 and a co worker (who also had USAA) basically ran over the front of it in the parking lot because he was in a lifted F150 and didn't see it as he pulled out. I took it to the body shop and about a week later they call stating that USAA was refusing to put OEM parts on the car. I was shocked and called USAA myself and asked what the deal was and why they were not using OEM parts and their response was "The car didn't have new parts on it when it was hit" to which I stated "yes but it did have OEM Honda parts on it and I wanted the damaged components that could not be repaired to be replaced with OEM components. Without making a long story longer, they refused to put OEM components on my vehicle and would only pay for "refurbished and aftermarket parts" so I just paid out of pocket the difference. I then cancelled everything that I had with USAA. Life insurance, home, auto, and 3 checking/savings account and wiped my hands clean of that crap company. I expect that from "The General" but not USAA.

My worry was that they weren't going to take care of my family if something serious happened if they couldn't do the right thing with a little sports car.

I think they get too much hype because of the military deal. That's cool and all until you get some refurbished parts on your ride. No thank you. Hard pass.
