Advice needed with an issue in my neighborhood

    Hey guys,

    I need some advice on a neighborhood issue.

    A little setup here... bear with me...... I live in a newer community with an HOA. In our neighborhood, the mail boxes are placed in banks around the neighborhood. Each bank may have 25-75 mail boxes; 1 for each property. And there are about 10 banks around the neighborhood. We also have a social media website for our neighborhood (Nextdoor) where the residents can communicate on a variety of topics. One such topic is lost pets. Surprisingly, there are a great deal of lost pets in our community. Typically, residents post on Nextdoor, but, sometimes, a resident will post a flyer on the mailboxes. I guess this makes sense since everyone will see it when they get their mail. In addition, our community is surrounded on 2 sides by rural areas and there are lots of predatory animals in these areas; coyotes, foxes, owls, snakes, etc. The sad thing is that a lost cat, for example, usually has very little chance in our neighborhood.

    Ok, on to the issue.... a resident has lost 2 of her cats. She posted about the loss on Nextdoor and she placed flyers on all of the mailboxes in the neighborhood. After few weeks, the flyers fell apart because they were exposed to the elements (wind, rain, etc.). So, she started to laminate the flyers and tape them to the mail boxes. Well, they didn't stick too well on the mail boxes and they would eventually fall off and blow away. So, next, she used duct tape around the 4 edges of these laminated flyers and taped them securely to the ground in front of the mail boxes. After a few months, other residents in the neighborhood had been getting tired of seeing these flyers all around the mailboxes. Some people started to pull them up and throw away these flyers. The lady who lost the cats was incensed and began flaming people on Nextdoor. She also promptly replaced any "missing" flyer, but now, she writes on the tape on each flyer, "DO NOT REMOVE". It has become her mission to ensure that these flyers remain at the mail boxes.

    Well, now.... it has been over a YEAR! And she still is on this mission of taping these flyers in front of the mailboxes. These flyers have become a nuisance and the neighbors are getting pissed. She swears that her cats are still alive and that someone will find them (however, we all know that they are dead by now). So many residents are ripping up these flyers and throwing them away, but this lady still insists on replacing them. It is now a battle.

    I checked the HOA rules, but the sidewalks are not in the HOA domain; they are controlled by the city/county. I checked the city and county websites, but I could not find any laws pertaining to this issue.

    Can you guys think of any sort of legality here? Is it legal for her to tape all these flyers in the neighborhood? On the flip side, is there any legal issue about throwing them away?

    I see these flyers as trash/littering, but what do you guys think?

    There will be no end to this. It will continue for years to come. She literally stated on Nextdoor that she will never give up and she will ensure that these flyers remain until her cats are returned. Do we just let he have her flyers?

    Only one option. Go rescue 2 cats that look like hers, and reunite them.

    Since I stepped in cat poop today and dont have ANY cats.:mad: I wish the neighbors would keep their cats at home.
    Tape a flyer to her mailbox explaining what wildlife you have in the area and what happens to cats if you dont keep them inside.

    Yeah that’s a tough things to deal with. Maybe you can draw a Chalk outline of a cat out next to the mailboxes? Ok bad joke. I seriously doubt her cats will be back after a year but who knows I guess.

    Most municipalities have rules about posting flyers. If yours doesn't or doesn't enforce them and it's out of your HOA jurisdiction, you'll probably have to live with it. Or see above^^^^

    I would talk to the HOA and have them vote/make an amendment to the by-laws of the community regarding posting of signs. This is probably the only way it will stop. It sounds like everyone will vote yes except her. Good luck.

    Post on the web you saw a happy coyote with her two cats in its mouth, and the story is over.

    Otherwise, there is no ordinance against littering? If not, this may be a general public nuisance.

    I actually believe it is illegal to post signs on “Federal property” being that the mail boxes should be owned by the United States post office. This is straight from the post office website

    It does say, "Collection Box", but I'd venture to say the neighborhood mail boxes might have the same protections.

    Nextdoor is terrible. Just a bunch of old cat ladys acting exactly like you describe.

    If the previous posts of rules don't apply, I would just keep taking them down as you see them. Copying and laminating is not cheap if she is going to Kinkos or whatever. She might give up.

    You may have a CHUD living in your sewers eating cats. You should probably put up fliers on top of hers warning people about CHUD, especially close to Halloween.

    Or you let the lonely cat lady keep doing what she’s doing. Don’t really know how her life really is. Maybe that’s all she has. Not justifying littering. Everyone has a story that we don’t know.

    She is married, has 2 children, and owns 3 dogs. She has a professional job and is able to work from home. Other than this lost cat obsession, she seems normal.

    The homeowner actually owns the mailbox but the government owns the "space" inside the box for the mail. That's why FedEx, UPS, Amazon, etc...can't leave packages in the mailboxes. Have you actually asked the lady to stop posting these and creating litter? If that doesn't work, maybe put a no trespassing sign up and depending how far you want to take it, get the local authorities involved.

    Your City/County will likely have ordinances regarding posting unofficial messages on city/public property. Research the applicable ordinance, and file a complaint with City Code Enforcement. Let a Code Enforcement Officer handle it, and ignore social media sites. Good luck.

    I'm sure the city or county probably has an ordinance against littering, which is what this woman is doing at this point. It's just a matter of finding the right contact, and most municipalities require a written letter requesting intervention. I would just throw them away at this point. Eventually she'll get the hint. Might be 2 years from now, but she'll give up.

    I think the cats had the right idea. They can sense crazy.
