    I haven’t to be honest, her insurance treated me like shit, so I filed a claim with my insurance and said have at it.

    I’ve never heard this in my life, but her insurance was weird. She didn’t own the vehicle. It belonged to a homeless shelter and they had an insurance company that I’d never heard of listed on the accident report. Their website stated they were an insurance company for “non-profits and compromised hunan services”, IE a homeless shelter :monocle:. So I filed a claim with them online, but no matter how many times I called or voicemails I left, it took them 6 days to call me back. The adjuster “claimed” I didn’t leave my contact information even though it asked for my name, phone number and email in three different sections on their claim form.

    Then she dropped the real bomb on me. :nuclear:

    She stated that the insurance I filed the claim with was part of a “non-profit insurance co-op for human service organizations” and that they didn’t have the resources for a full salvage should my truck be deemed a total loss. (o_O) So if it is deemed a total loss (which could take 2-3 weeks as it would take them quite a while to get an adjuster to inspect my vehicle) then they would issue a diminished value check and then release the vehicle to me to recoup the remaining value myself.

    So I said, “Basically you’re telling me this. Your client ran a red light, likely totaling my truck, injuring me, and could have injured or killed any passenger on the side of the vehicle hit by your client. Then, when you finally find time in your schedule and convenience to get an adjuster here to inspect my truck and they find it totaled, which, I’ll tell you it likely is based on damage, age and mileage, you are then going to write me a check for less than it’s worth and give me back my busted ass truck to then try and sell it off myself?”

    She replied, “Yes, if you’d like to put it in laymen’s terms, that’s what we’ll do.”

    Normally, I’m fairly nice and level headed when it comes to customer service folks. But I lost it. I gave this woman a solid 3-5 minute sailor laced ass chewing. I ended the call by saying that I was cutting all contact, and if her dumbass or anyone else from her Mickey Mouse circus of an insurance “company” needed to reach me, they can reach out through my insurance company. I then told her to prepare to be f***ed by the big red d*** of State Farm.

    So far, State Farm has been much better. There’s been a few hitches in the gitty-up but otherwise it’s been alright.

    I’ll put the dashcam footage up on YouTube, that way I can share it with you guys to see the joke I’ve been dealing with.

    Anywho yeah, if your insurance isn’t going to go after them you should get a lawyer that will, that’s some bs… if you want to put it in layman’s terms? You mean the truth lady :rofl:

    Wow, i had no idea. This must be specific to the Tundra? My 2020 Tacoma off road had chrome headlights.
    Guess that explains why the 2020 Tundra sport my buddy bought used a couple years ago had black headlights. We thought the previous owner already switched them out

    If you catch any more grief at all, I'd reach out to an attorney that handles 'bad faith' cases. Basically, insurance companies are required to operate in good faith, and if they fail to do so, action can be taken against them for not only the incident itself but punitively for handling the claim in bad faith... These parameters are dictated by the individual states, but for the most part, every state has legislation prohibiting insurance companies to act in bad faith.

    Start doing a little research now though, and find a reputable attorney to have that in your back pocket if it hits a point where you're going to absorb any of this mess, OR if it hits a point where your insurance company is going to handle it as that will result in a potential for increased rates, etc.. if they use an uninsured or underinsured clause within your own policy.

    PS>>> Avoid ambulance chasers or heavily visible attorneys for something like this. You'll want someone w/an extremely good reputation through word of mouth, but there online/AD presence is minimal (cause they don't need it)... Reach out to someone who knows a good attorney (doesn't matter what area of practice) and ask them for advice on who they'd use. Repeat this process several times, and you'll have the same name come up a couple of times. When you research them, you won't find much, but you'll see the law firm is stable and has been there a LONG time... (this is probably the guy/gal you want to use)...

    FYI... Bad faith claims can be VERY high dollar claims, because there is generally no limits or high limits to the punitive damages that can be assesed in such cases. EX>>> Friend on mine had a minor injury accident (about 60k loss for vehicle plus medical), at fault driver's insurance (big name company) failed to handle in good faith, and the they sued for original damages plus the attached the bad faith claim to it as well... end result was full recoup of expenses, attorneys fee, and pain and suffering (about $100k).... but, here's the kicker... The courts came back on the bad faith claim w/an amount of nearly $2m against the insurance company.

    These types of laws and potential settlements are made to keep insurance companies in check, and while they'll often f^&k around, they VERY rarely will put themselves in this kind of position once they are put on notice.

    Obviously, this is not what you hope to deal with, but just know YOU have options as the victim vehicle in this situation.

    But, with all that being said, I hope you are simply taken care of don't have to leverage anyone!!!!

    I appreciate it. I'll start looking into it. I've got a lot going on in life outside of the wreck, so I've been avoiding it just to keep my head above water, but you "make a good case" lol

    Litigation is never the goal, cuz that's a long road and the attorneys are really the ones that come out on top in those scenarios. But, it is nice to know that you do have recourse and don't have to sit back and take being treated like crap. We all pay WAY too much for insurance (and everything else these days), so the least they can do is honor the spirit of their contracts and do the right thing!! Good luck on a smooth process!!

    I can't agree more. I did watch my girlfriend go through litigation on a wreck back in 2013, and you're completely right about the time it takes to get through the process. She was rearended by a unlicensed immigrant in a friends unregistered early 2000's Ford F150, but strangely it was still insured. She went after the other insurance when they gave her a ridiculous offer on her '08 Pontiac G6 and ended up getting more than she originally paid for the car. Unfortunately, they were bound by contract on her medical fees, so they weren't able to get anything over the policy's medical coverage. No pain and suffering. Physically she was fine, they transported her by ambulance because at the time of the accident she was 5 months pregnant with our first child. Subsequently that's how we inadvertently found out we were having a boy thanks to a loudmouth OB intern. We had been keeping the sex a surprise, but when they started doing testing in the ER to make sure mom and baby were ok, DR. loudmouth asked, "Oh, do you know what you're having? It's so obvious! We've been going in depth on ultrasounds and it's very fascinating!" She was quickly shood out of the room and we could hear the verbal berating she received from the attending for what she'd done lol.

    Same thing happened to me last month. I was towing a trailer on a skinny two lane road. Here comes this lifted superduty with the tires sticking half way out the fenders :rolleyes:. I'm over as far as can be and BOOM, sounded like a gun went off. Good thing I had my sunglasses on because I got showered with glass. Mirror ended up in my lap. Since I was towing I had to stop at auto zone and bought a snap on interior rear view mirror ( all they had). Zip tied that to the existing no mirror in order to make it the 1.5 hour tow home. Bought a new Chyna replica mirror from Rock Auto for $85 shipped. Looks exactly like the OEM mirror but makes a little whistle noise around 50 mph. Gonna seal a seam with silicone, should be good after that.

    I'm sure you already spent the $300 but next time (hopefully there is no next time) check out what Rock Auto has, way cheaper than OEM.
