My wife has a friend who got involved with a billing fraud case. I don't know the details but long story short was working here on a Visa from Canada and didn't have much choice in the matter. He was charged with felony and is expected to do 6 months federal time.

He has been offered to surrender and start his sentence in a county jail here in California, or wait for his official term and go to a low security prison in Texas. His official term in Texas starts early November.

    Which would you do?

Well you have a higher chance to make someone your bitch in county. And a slightly higher chance you gonna be someone’s bitch in state. But if you’re the type that’s just gonna end up being someone’s bitch anyways, really doesn’t matter.

I asked my cousin, who is an expert, and he said jump on county all day. Since people are awaiting sentence there they are on better behavior.

I'm not sure about this, but will they be able to stay in the US in the visa?

    https://www.findlaw.com/immigration...elony-convictions-and-immigration-status.html

How Does a Felony Affect Immigration Status?

Created by FindLaw's team of legal writers and editors | Last updated January 23, 2018

One of the last things you want to do if you are in the United States on a visa or green card is commit a felony. Immigration officials may deport you or downgrade your status on the basis of a felony or even a non-felony conviction, depending on your current status, the type of offense, and the specific facts surrounding your case.

Moreover, convictions for crimes involving "moral turpitude" or those labeled "aggravated felonies" carry harsh consequences for non-citizens. A non-citizen who commits an aggravated felony or a crime involving moral turpitude is generally ineligible for relief from deportation and often will be barred from reentering the U.S. in the future.

So just talked to my wife who works for/with the Santa Cruz County Jail. She recommends going to county because time served in county counts as double here in California. I guess the dude would be more board in county as there are far less resources for people long term in county, but to possibly cut the sentence in 1/2 would be worth it.

Its a Federal case?? sounds like a deportation case right after, should spend some time to figure out the outcome right after and close out any dealings that are pending personal property shipped out just in case.... Not sure county counts for Fed time..

with covid he might not do 6 months at all and be released early. I would start early and be done with it. Jail is not fun but not the end of the world either.
Not like he killed someone or pedo.

I'm no lawyer, but come to think about it, we had a Canadian squadron that did a detachment out in my last command in Southern California.. Long story short, one of the members from the squadron got caught with the "Devil's lettuce" (WEED) LOL.... Unfortunately for him, he was arrested at the border security check point West of the city and was subsequently deported shortly after.. This was back in 2009-2010 timeframe.. We found out, because it was a small base, probably 150 people with civilians, so rumors spread fast like California wildfires.

Once his time is served he will be sent to Canada, at least thats what he has been told. I told him too bad he can't go to a prison in Canada.

County jail will most likely be a more horrible experience than federal prison on a 6 month stint for a paper caper

Time served would count towards his sentence, but from what I understand it won't shorten his stay.

What federal prison here in tx?
My family (not me) is unfortunately familiar with the prisons here. My father did 5 years in federal. My sister bounced around in county and state.
I can tell you that doing 6 months in federal would be a much better experience than sitting in county.

bastrop and seagoville are the 2 that I’m familiar with.

Not sure which one. As soon as he said Texas I started wondering why Texas and missed that detail.

My wife retired from the Bureau of Prisons, and she says your friend will be "absolutely fortunate" to do his time at a federal institution compared to county.

There is no way to predict which institution it will be, since the BOP has employees that do nothing but figure out where to assign inmates. Assignment will depend on the circumstances of the arrest; i.e. possession of firearms, co-conspirators, as well as location of family, special medical needs, etc. I would guess nationality is another consideration.

Security level at federal prison varies from camps that you can literally "walk away from" to low, medium, and maximum security. If your friend was guilty of low level "white collar crime", then one of the camps is a possibility. Bastrop is medium security, and I think Seagoville is low security. Other possibilities are Big Springs, Texarkana, Beaumont, Three Rivers, Fort Worth, Carswell. and La Tuna.

According to the Jack Reacher books I've read, county lockups are nicer than prisons...

Nope. Fed time is day for day. Who knows what crazy thing Cali does, but I am familiar with the BOP (not personally) in Texas. Fed time for what this sounds like will be a cakewalk. Id wait for the fed facility. County Gen Pop means you are in there with everyone with various crimes. Low risk fed prison is completely different.

I'm no expert, but enjoy watching all the "locked up" shows, county seems like the worst option. People are pissed and trying to harden up for the big show...also since its a revolving door, its gonna be a shit show.
In federal prision, people know how long there gonna be in there for and want to serve their time and get out.

I've been to both. FED all day long, countys are absolute crap.

I also don't see Fed time being done in a county facility.

I would try to confirm if the time served in county would be credited for double time as is California policy. If that’s not true, then I’d would agree with going to the federal prison.

Edited my pic after re-reading legal language.

Agreed, and I am not a legal mind or familiar with Californa law. But here, where he has been sentenced, fed time is day for day, no parole. State language for state level charges works the way you posted. Federal BOP statutes definition of "good time credit" is very different.

Again, I'm not a legal mind.

Plenty of opinions here, which I can't provide since I know nothing about the matter.

However I'd be interested in knowing more about. Thanks.
