A Gun Trust?

    I already have a 16" Colt, if I bought a sbr upper first in my build process and have not assembled my lower with a pistol buffer tube and brace then am I technically pushing constructive posession? Even though I would never mount the sbr upper to my Colt lower I could.

    From what my friends in the gun industry had told me, they changed the law a few years ago and once a lower is built into a rifle it can't be converted to a pistol, only a sbr. For that reason of you don't have a dedicated pistol lower, you can't have a pistol upper in the house until you have your sbr approved.

    My lower is assembled minus the pistol buffer tube and brace, should be in next week, my upper only has a forward assist and dust cover. I don't plan on ordering a short barrel until the lower is complete as a pistol lower so I should be ok yea? Thinking of keeping it a pistol unless I decide to give Uncle Sam my particulars to be imputed into the "beast". At that point I will add a carbine buffer and stock if I decide to get a stamp. Am I on the right track here?

    If you purchased a new lower that has never been built and then add the pistol buffer tube on it and then order the pistol barrel or pistol barrel upper, then you would be fine. That is the same thing I did when I did my first SBR. The good news is that if you efile for the Form 1 to make a SBR, the wait times are only like a month now. If you don't efile, the I think the waits are around 6 months or longer. Don't forget to have the lower engraved. If you are setting up a trust and having set it up yet, then I suggest using the shortest trust name you can as you will need to have the trust name engraved on the lower.
