It’s probably not a good idea to give me strong beer. I am a thirsty drinker! I can have one or two at eight or 9% but then I’ve got to go back to my light beer.

Portland Oregon started the craft brew "thing" in the 70's. Portland still puts out some of the best brewskies around. Got a good "head" start years before Colorado.

I like the light beers for the "drinkalldayability". Aftermath of working on my other car:

Started at 2pm, stopped at 2am. Try that with 9%.

Actually if the keys were in the ingintion it sort of changes things. Even if the car ain’t turned on it can be considered a dui if keys are in the ignition.

    Just an Up date.

    I have been to court 8 time's.
It's an hour drive one way.
    I have driven 1000 mile
    Missed 8 days of work
I drive up there stand around for 20-30 mins
every time someone is not ready,or someone is out sick or on vacation.

August 11 it will be one full year since the arrest. I cant believe they are still dragging this out, especially for a DUI when I was not driving. my girlfriend was driving.

What ever happened to your right to a speedy trial.? Riverside court house has been very unprofessional handling this case.

Next court date is Sept 10.

What does your lawyer say about the speedy trial issue? That should definitely be a reason for a dismissal.

Definitely not an excuse for the lack of your speedy trial but the whole system is packed everywhere. I was served a subpoena for a case and I'm 3 years into retirement..

I hope that you are able to beat this and sue to get back lawyer costs plus expenses for travel and missing work. This is the biggest load of horse shit I've read in a while. I'm not even sure what the lesson is here. One would think if you're not driving you don't have anything to hide so taking the breathalyzer is fine. But you clearly got f***** here. I'm honestly shocked that they would even arrest you. I have to think they are delaying because they know they screwed up. Our legal system is just that, a legal system. It's not a justice system and there is very little done to officers when they break the law or screw up. I once had a good friend of mind(a cop) tell me that you have to violate people's rights in order to catch the "bad ones". He openly admitted they brake the law in order to arrest people.

One of my customers’ son was murdered in 2017. The guys who did it plead guilty, and they were just sentenced last week. Almost two years to the day of the murder. He couldn’t understand what took so long when they plead guilty from the start.

My first lawyer has been moved to a different case. I just meet my new lawyer yesterday. I'm going to call her in a few days to find out about serna motion, maybe i can get this dismissed.
I dont think they can keep dragging me along like this.
It's starting to become a financial hardship. I live paycheck to paycheck, I have bills and child support.

My girlfriend has to take time off of work also, so she is missing out on her paycheck also

I've got lots of friends who are LEOs and I certainly wouldn't want their jobs. Problem is the many good ones get grouped in with the few bad ones and the rot continues from there within the brotherhood. Good COPs and teachers don't get paid near enough to do what they do, but that's just my $0.02. Hop you get this all sorted out soon OP.

What's bullshit is that if you or your lawyer didn't show up, you'd be convicted on the spot. But if the local DA doesn't, the judge delays it.
    Bullshit.

There is, just like this case would have been dropped like a bad habit if there wasn't proof of some sort that you weren't driving. Cops don't have to see you driving to arrest you for DWI..... contrary to belief on here. It's either they see you, a credible witness sees you or you admit to driving. This would have been thrown out day one of trial and they would have had their asset's reemed that day. Cops can't just make their own arrest without more than just reasonable suspicion.
