    I originally posted to check that frame. So that frame damage on a tundra should make your truck a total loss. Toyota does some form of heat treating on their frames (or so I've read) that makes it very difficult to repair. So I don't have any idea what advice to give but knowing that previously mentioned info, it seems to me if you have to pay all that money out of pocket, then screw your insurance company also and total the truck and go get a new one. Strip all your mods off and drop it off wherever and they can deal with it. I honestly don't know if that's possible but mathematically you deserve a new truck.

    Brian, I would be upset like no other. I know exactly what you’re going through.

    Your insurance will be going after her personally and you may get your deductible back as well. I would small claims that 600.00 plus rental car fees.

    If your in a tough spot, come down and take the Lexus if you need it for a few days. If there is snow in the forecast, you will be better off with boot on the ground. Lol.

    Modifications are not insured so I would definately be giving it to insurance at as close to stock as possible. Would find some cheap cL wheels, tires and shocks.

    I also wouldn't expect your premiums to go up because of this claim since you clearly weren't at fault and the police report will say as much.

    I've had 5 people rear-end me at stop lights and one hit me head-on over the past 14 years. None of them were my fault and I never had any increase in my premiums even after using my collision coverage for the one that had no insurance.

    Be extra careful now though because if you have a accident that is your fault they'll nail you with a huge rate increase.

    Someone helping me back a trailer in close quarters wasn't watching my blind side close enough and guided me into the side of a van without giving me any warning. I noticed my truck slow down and I stopped before he said anything about being close to it. (Real big help he was.)

    After reporting that accident my rates trippled. Now I have to be depressingly cautious every time I drive so my rates will drop back to normal after a few years.

    Must have in TX with all the undocumented. I have a $250 deductible on mine. Saved my butt when ex had a wreck in my Grand Marquis. Other person had no insurance and no license. They lawyered up claiming my ex was at fault. Problem was the police report had the people on the wrong streets. Took months for my insurance to straighten it out. Progressive did a great job on it.

    I have separate rental car and uninsured property damage. Deductible on uninsured is $250.

    Just dropped off the truck at ABRA Auto Body and Glass (http://abraauto.com).
    Picked up a Chevy Silverado at mid size price for a week rental. Will extend it out as needed.
    Estimated time in the shop is 2-4 weeks depending on repair or replace.

    I felt like crying leaving my tuck there. Was it the right decision? Will I ever see her again?


    Summary of insurance items:
    • The person that hit me was sited for careless driving and failure to provide proof of insurance. Turned out that she either was not covered under the policy or it expired without renewal/failure to pay on time.
    • The property damage goes under my collision insurance with the note that i am not at fault. The claims rep said it should not affect my premium but i should check locally with my agent.
    • My insurance is covering all damages and the car seats. They will file with collections to get the money back. I get the deductible back if they pay.
    • My insurance is not covering diminished value, time off work or rental car. Will have to reach out to the courts to file something separate if i decide that i want to go down that path. The time and effort it will take to do this might mak worth it.

    In the end it is just a replaceable piece of metal. I'm sure everyone on here who loves your truck and the info you provide to us newbies, me included, are still more concerned and happy that you and your family are all okay, especially during the holidays.

    If you never see your truck again then every year we will have a "drink to CSUVIPER V1" and then click over to your new build thread.

    But at least you can see all your family and friends every day, even in a sacreligious Chevy.

    I don't know what your financial situation is, but after going through the frustration of a justified lawsuit to try and collect from someone that cost me a significant amount of money through negligent behavior I've decided it's usually not worth it.

    Using money you planned for something else to fix another person's screw-up sucks, but life is much better if I just get what I can out of the insurance companies, chalk it up to experience and move on. (experience: I lowered my deductable from $1k to $500 after an uninsured driver hit me and I got nothing out of them.)

    Remember that your quality of life has some value. Is a few hundred or thousand dollars worth it if you have to be angry and miserable for 6-12 months to get it? Maybe so, maybe not.

    Also, if they don't have insurance what do you think your chances are of getting any money out of them through a lawsuit anyway even if the judge does find in your favor?

    A friend of mine won a case in small claims court and was awarded $9k for livestock killed by someones dog. The dirtbag didn't have any money or significant income so he never paid a dime. (At least it was legal in that state for my friend to shoot the dog when he found it in the flight pen with 200 pheasants dead and 400 missing.)

    Body shop just called and said that the frame is going to be fixable. They will be writing up the estimate today and getting that sent to insurance.
