    That’s nuts. How dare you distract the Ram owner from his text messages.

    All joking aside, if you have never been in an accident like that there are things to consider outside the truck.

    Diminished value is one of them. A 2 year old truck should get you a payment. That adds to the cost and should put you over whatever stupid threshold the insurance company has. I wouldn’t want it repaired and given back to me if the frame is bent.

    The other thing are ongoing medical bills. I got rear ended in 2013 in my weeks-old Ford Explorer. I got ~10% (of the car’s value) for diminished value. My physical therapy was about $5k. When the insurance company called to offer me $1k to sign off on all other claims, I told them I wouldn’t sign anything unless they paid me the equivalent of another round of therapy.

    A concussion and back pain are no joke. If I was in your shoes, I would consider getting a lawyer too.

    Smartest move you can make. Hope your fully recover. Don’t talk to anyone including your insurance until you consult a lawyer. Your insurance company doesn’t care about you, hire a lawyer to work for you!

    The shitty part (other than your injuries) is it’s hard to find anything comparable without overpaying out the ass. This should be consideration if your vehicle is totaled.

    Go to a doctor and get X-rays. I was rear-ended in my 2006 Corolla XRS and I felt OK, just a little sore. Well years later, it turns out one of the vertebrae moved. I was warned not to let a chiropractor do their neck cracking. It could leave me paralyzed.

    If they hit you hard enough to cause a concussion, I would not settle anything until you feel 100%. Rear ending someone at 50MPH is a big deal and your lawyer should have the insurance companies full attention until this is settled.
