Yet Another Towing Question - About CGVR

    I plan to take my Tundra and horse trailer south, to USA, once the border opens and the wicked beast Covid is gone.

    Someone told me that the DOT down there is pretty strict.

    My truck's GVWR is 7,110 lbs and I am under that when loaded and with the tongue weight.
    My trailer's GVWR is 10,400 lbs and I am way, way under that with the trailer loaded at 6,100 lbs.

    The Tundra's legal CVWR is 16,000 lbs.

    I was told that the DOT could stop me anywhere and look at my truck door and trailer plate and add up the two GVWR which is 17,510 lbs, over my Tundra's CVWR 16,000 lbs by 1,510 lbs. And I would get a hefty ticket.

    True? Remember that this is a horse trailer not a recreation vehicle.

    You already have your answer- same info given in your other towing/horse trailer threads. You have asked multiple times, over weight is over weight, asking again is not going to change that. If you are stopped and checked on weights, yes you could get a ticket.

    I took truck and trailer to a scale and I am NOT overweight on the scale. That is what is confusing. Anyway, how in the world would the DOT know that the CVWR is 16,000 lbs for my truck? It is not on the door of the truck.

    As long as your actual weight is under your trucks weight rating you are fine. It doesn't matter if your trailer is rated for over that if you are not loading more than the GCWR of your truck.

    You don't have tp stop at weigh stations as a non-commercial vehicle.
    Unless you have an obvious problem, like swaying, you don't have much to worry about.
    They're more focused on commercial operators.
    If you do happen to get pulled over for a check, they'll weigh you right there.

    Simplest answer is the correct one. If you aren't overweight you cannot be fined.

    Most POEs require all vehicles with livestock to stop. Even private ones. She is doing good to check before her trip.

    That's not DOT. That's Customs and Iimmigration.

    If they weigh me I am good. It was a commercial operator who drives in the USA who told me that the DOT adds up the truck's GVWR and the trailer's GVWR and check it against the trucks "combined" weight rating (GCVWR). I don't have a problem in Canada

    The answer is if you are or are not in commerce. Simple as that.

    If you plan on going to horse shows or competitions where you can make money AND they can reasonably say you are commercial (or in commerce) this is where you can have an issue.

    Some things that might stick out to a DOT checkpoint:

    -Having a business logo on the side of truck/trailer. This is a dead giveaway that you are in commerce especially if you just pull out of a stock show.

    -Learn this phrase “I’m not in commerce” and just enjoying a vacation.

    I have the same problem with my trailers. Truck GVWR is 11500lbs and trailers are 16000lbs. I’m over the 26001 lb rule for needing a Class A CDL. It doesn’t matter if I only have 10000 lbs total trailer weight. My only saving grace is I’m a private party and not in commerce.

    Not sure if your comment was directed at mine. If it was, then that is incorrect. The DOT POEs between states have nothing to do with immigration or customs, and they require livestock to stop. They check health certs for the animals to prevent the spread of disease in the livestock populations.

    True, although they do all that at the border. I have never been stopped even going from New York state to Vermont to check weights or health certificates. I have taken my old horse trailer south for years now, but it will be the first time with my new, heavier, horse trailer.

    Do you have livestock in the trailer, or is being used for other things?

    These are the signs you have to watch for. White signs with black borders and black letters are law. Not suggestions. If the ports you pass through don't have this sign, you MIGHT be ok to drive by. You can also call any port and ask them if you need to stop if you are a private vehicle with a horse trailer. You're not overweight, so I think you'll be fine unless they want all livestock to stop like shown below. (This pic is the Echo POE in Utah.)

    I have never seen that sign. I trailer my horse to New York State and Vermont. Actually, even at the border they don't check weights. They check the registrations and if my name is on them all is good.

    You're likely all good then. Even if they do weigh you, you are not over weight, so you'll be fine.

    If weight isn't a problem, DOT has portable scales if they pull them out you are going to have a bad day. Problem is you WILL have to stop because you are hauling live stock from a different country, make sure you have all of your papers for said live stock.

    If she's not over her weigh limits there is no reason she would have a bad day getting weighed.
