    Your rates wont go up as long as your not found at fault by your insurance carrier. If the other persons insurance is not responding go through your carrier. They will subrogate against the other carrier to collect on the loss and your deductible. I always encourage people to go through their own carrier and let the insurance companies hash it out. You pay for full coverage might as well use it Good luck!

    So my question now is, USAA is giving me a decent number on my truck, but the other guys insurance came back and asked what my "demands" are. Can I get them for more than what USAA is doing, like for "pain and suffering" and basically this all being a huge pain in my ass because of their idiot client? I've never had to deal with insurance on anything.

    If they mentioned "demands" than they are asking about your pain and suffering, and possible injury you may have sustained and not the trucks value. You definitely have a case for pain and suffering and if you lost any time off of work because of it. Also are you in an rental? If not you also have loss of use which is owed since the Tundra was not drivable after the loss. The other insurance carrier would owe you what the cost of a daily rental is for a truck for the amount of time that you lost use of your Tundra

    Well we have a separate claim going for personal injury for my wife. I'm not trying to be greedy or an ass wanting everything, but think I should get a little out of it for P&S and dealing with all this. I did miss a couple days due to it so there is that. I am in a rental that USAA is taking care of and will be billing them back I guess. Problem with that though is I have to be out of it next week and the new truck wont be here until the end of the month. So I gotta figure out something to drive until then. Guess I'll call this guy back and see what more they will do.

    I agree being greedy is not always the answer. Present all of the facts to the insurance carrier and let them know what you would think is a reasonable settlement for the loss. I know some people earlier were telling you to get a lawyer I disagree with that unless there were some serious injuries or fatalities. An attorney will go in an do exactly what you are doing but you wont be losing 20% of you settlement to the attorney. Present them with the facts and I'm sure you will walk away happy.

    I see nothing wrong with expecting their insurance to give you more money. That's their job in a sense. It's not being greedy, just being practical.

    I was told that no compensation is ever enough. The hassle to get a new truck, the loss in time fighting with the insurance etc. can never be made right.

    The magic word is "subrogation" - when your insurance company goes after the other one. You shouldn't ever have to deal with the other guy's insurance. YOUR insurance company is supposed to be working for you; the other guy's is trying to screw you.

    I lost a friend from high school his first year at college to a drunk driver. I have NO sympathy for anyone who gets behind a wheel drunk. throw 'em in jail, pull their license - can't get to work? Too f'ing bad. get a bicycle.

    It's the OTHER GUY'S insurance ajduster's job to do that. YOURS is supposed to be working for you. Even better, get your insurance through a local, NON-company agent. THEY really do work for you, because they want you to keep being their customer. I pointed them at the insurance company and let go the leash when my car got hit.

    Why are you even TALKING to the other clown's insurance company? YOUR company works for you; they work for the idiot that hit your wife. Screw 'em; get your insurance agent to turn up the screws on the others guy's company.

    Disclaimer - a Lodge Brother was my agent for many years, two other Lodge Brothers work for an insurance company, and I used to work for the same company (although in IT).

    This is soooooo easy. If the other insurance company does not compensate you enough no worries (don't cash their check). You file claim against the person who hit you for truck cost, court cost, legal fees. They are liable not their insurance company. They hit you not the insurance company. Now they paid their insurance company to cover liabilities so as soon as that person is served they will call their insurance company and it will quickly move up the ladder to an attorney representing that insurance company not a customer service representative. A court date will be set but will never get that far, attorney will contact you and will settle very quickly. Only issue you may have is you don't get any money until it is resolved. This could take 2-3 months.

    You have got to get past the customer service idiots for the real $$$

    I made a mistake a couple of years back....I was in an accident and the other drivers insurance company called me on my cell phone the very next day. I hadn't even spoken to my own insurance rep yet. I carried on this nice conversation with the other party's insurance rep. I should have remained silent and only spoken with my insurer because they ARE the ones to take care of ME. Don't waste your time talking to the OTHER Insurance Rep.
