That’s one of the benefits, yes. It also adds a little more paperwork since you have to submit prints and photos for each “responsible person” on the trust. Trusts usually take longer for form 4 approval, too.

There’s also a small loophole - you can create the trust with just yourself on it, submit a form 4 for a machine gun, sbr, or suppressor, and after it is approved amend the trust to add additional responsible persons without doing anything else. You’ll have to make sure the trust is structured to allow you to add or remove people. Of course if you submit more form 4s down the road you’ll have to either first remove all the other responsible persons (and their access to NFA items) during the wait time, then add them back afterwards, or submit the form 4 with all the additional prints/photos.

An even easier way to handle this is to create a new trust for each NFA item you buy, so that you can add or remove responsible persons after it is approved as you see fit, and won’t require additional paperwork or juggling responsible persons on other items.

For reference, I’m an 07 FFL and 02 SOT (manufacturer of NFA items).

You can still form a trust, you will have to pay the tax again tho for the transfer from you to the trust.

With the announcement of the atf going after Q and all the owners of the honey badger rifle with a pistol brace there is a lot of talk they will be targeting braces all together soon. So with that said I think I will pay the tax man and just sbr a few of my lowers. What is the best way to handle this? For all my suppression I just used the SilencerShop kiosk so that made it very easy.

For SBRs the easiest thing to do is use the eforms system and do a form 1 for each firearm you want to convert. It’s relatively quick, usually 4-6 weeks for approval after you mail in your prints (as compared to 9-12 months for a form 4 these days).

Just a reminder that you’ll have to engrave the receiver or barrel with your name or trust and city/state, too, since you are the “manufacturer” of the SBR.

I'm getting ready to submit another form 4 this week after my fingerprints get done. We will see how long of a wait this one will be.

My F1's have all been under 20 days in the last 8 months, a couple were under 14 days. F4's are just stupid @10-12 months, I guess I should be grateful to the crown though, I had one take 18 months and another take 15 months, so it could always be worse.

Question - I have not done a form 1 since the fingerprints and photos rules when into effect. I have a trust and have prints and photos on file with silencer shop. I did the efile the last couple times for SBRs. Do I still do the efile and just request silencer shop sent me prints of the photos and finger prints to mail in? I have a Spike lower that has been sitting in the safe for a while (years) that I will build another SBR with.
