icbc claim. need help with canada British Colombia tundra owners.should i hire a lawyer?

    2015 tundra sr5 trd off road.
    my truck was in a accident with a construction company next door. the truck was parked and i wasnt in it. a forklift slid down a snowy hill and took my truck out with it. bumper,bed,cab,front skid plate and maybe front bumper was damaged. it is high centred over a rock. the forklift was un plated and uninsured(but construction company probably have liability insurance). should i hire a lawyer? if the insurance company want to fix my truck can i ask them to write it off? since i don't want depreciation in value when i sell the truck?
    what would be the best way to go about this?
    truck is in the shop(icbc credited) and i havn't got contact from the adjusters since the accident (jan 15th 2020)
    i think he'll contact me on monday.

    the construction company was recently trying to find about that this ally way was own by the city(public road) or the mill(private, the brown structure in the top of the photo) because i also call the city to find out if its a public road or private and they couldn't really give me a answer.

    the left side of my truck is a building that is city owned that i rent from.

    icbc is a BC canada insurance company.

    Having grown up in BC and dealt with ICBC a few times...lawyer up. Even if it's just to have the lawyer review the case and documents before you sign anything. Also, don't accept the first offer insurance gives you. They low ball big time in hopes you'll take it. ICBC is a corrupt organization and will screw you over in a heartbeat.

    Hi,
    I’m another BC’r....ICBC customer as well.private collision coverage.
    Years ago I was rear ended at 50 kmh by another driver.
    Other driver 100 percent at fault.
    My vehicle repaired with new factory parts....rental covered ......no injuries.

    however when I asked ICBC for depreciation compensation....they acted like they did not know anything about it.
    But they do....took me six months of emails and negotiations......to get 90% of what I was asking for.

    I believe now they say you have to sell the vehicle and prove that you received less than market value....if so I would tell them I’m not signing off until I sell the vehicle. Or sue the other driver in small claims court.
    Get at least three written appraisals of what the values were before and after the accident damage.
