    Best thing, be honest with the neighbor. Neither you or them really created the actual property lines.
    Show him the survey, let them know where everything is, this is yours and that is theirs, period, and you will be doing on your property what you want and they can do to their property what they want.
    Ok, unless there is a major encroachment on either side, then attorney is not needed.

    Grass and bushes are not major, building/structure are.

    As a surveyor - I hate you. We need to be able to identify the property corner evidence beyond reasonable doubt, and by encasing it in concrete you have made it impossible. Then when we would have to go and re-establish the property corners we would find that the concrete is in our way. All I can say is don't ever hire a surveyor for you're property unless you're ready for a large bill.

    no worries, i'll never buy a house without a proper survey going forward. this was my first house purchase and some ignorance on my part. Met with the neighbors last week, told them we had two options. We call it a wash, or we each take our land back. I'm open to either. They may prove to be a little more difficult as they want to now make sure everything is done properly and by the book. They took off for a 3 week trip so they'll come back with an answer.........nowwwwww to make sure that I have 100.6' in front of my house before I go talk to my other neighbors :D

    Even better: use pink spray paint to draw a dashed line through their front lawn and into their side yard so that it looks like the survey says the corner of their house is on your property. Then tell them with a straight face that you feel the only fare thing to do is to demo enough of their house to satisfy the setback codes. I'm sure they'll think it's hilarious once you tell them the truth a few weeks later. :stirthepot::thumbsup:

    Imagine if you had gone head and built without getting a proper survey as some had suggested.

    IMHO, It appears that the truth has kind of destroyed your goal. I would find some sort of compromise that keeps some sort of peace and hopefully friendship with all of your neighbors. It costs money to move fences, and it is worthless if there is no immediate benefit. But I would also suggest to all involved parties that the property stakes/posts should remain for the benefit of all current and future owners.

    For example: My neighbor behind me did a survey. The result was that the existing fence crosses the property line in a near perfect "X" that creates two equal shaped pies where I have some of his land and he has mine. (it's about 1.5 ft at the "crust" of the pie. very negligible). We have both agreed that there is no benefit to rebuilding the retaining wall and fence "on the line" at this time, but when the fence or wall deteriorates and needs replacement we have agreed to evaluate and re-build it in the proper place at that time. Or if one of us moves, to inform the next buyers of our discussion.

    BTW OP, you seem very level headed and I'm sure that this is your plan. I mainly posted this for the benefit of other readers.

    lol, so I lost part of my backyard, fence went up a few weeks ago. They still need to cut out the front yard, hoping to have that done by end of month.

    Pay for the survey yourself, you're the one that wants it. Its not that much anyway.
    I wouldn't pay them a cent, tear out whats on your side and do what you need to do and be done with it.
