Just a heads up. The guy selling these posted on AZTG FB page and when I asked for some photos that would’ve confirmed authenticity he deleted the post.
Lots of fake baofengs and Nagoya antennas floating around these days. So it’s worth confirming what you’re getting.

    General info:
The “UV-5R” was discontinued Dec 2014. So most guys selling those are probably fake. Also the stepped, less tapered base Nagoya antenna was revised long ago, another sign.

So... I just posted this thread over to one of the SoCal threads because a few new people are thinking about radios. Aside from the warning above, that these may be some kind of alt-brand, my concern is the pre-programming. Anyone know what that means? Although they present it like it's a good thing, it's a better thing to program it yourself so you have nearly unlimited channel options....

my understanding is that they are pre-programmed with all you need. I programmed my first one a while back and just loaded everything on it. You need a cable and software + files/PC to do it. For people who don't want to do it, I think this is a good option. you can always add some channels yourself manually after.
the software and file help you load a 100 at a time. much faster process imo

If you are going to use these during Rule of Law times, make sure you know the laws and requirements!

Example: FRS channels can be used with a maximum of 2 watts unless you have a license. License also needed if it has a detachable antenna.

    MURS: max of 2 watts.

    GMRS: license required.

Operating in the Amatuer Radio (Ham) frequencies: license needed.

Operating on a frequency you don't have a license for is also punishable.

Operating outside these guidelines is punishable by fine, imprisonment, and/or gear confiscation. (Fines can be hefty)

    https://www.fcc.gov/sites/default/files/personal_radio_services.pdf

    http://www.arrl.org/news/florida-ha...sed-radio-transmitter-and-interfering-with-li

Directly from the battleborn website: "
    Do I need a license?
Like anything federal, this is a complicated question to answer. A license may or may not be required depending on the frequency range you are operating in. Below are general guidelines and are not meant to be an interpretation for the FCC rules.

MURS Band – 5 Channels – Receive only
FRS Band – 22 Channels – Receive only
    NOAA Band – Receive only
    FM Radio – Receive only
VHF – License Required to transmit
UHF – License Required to transmit"

    Their site says:

“We take the guesswork out of choosing the right offroad communication device. Our radios come pre-programmed with our stock preset list which includes offroad race org operations, emergency channels, MURS, GMRS, and FRS presets as well as NOAA weather reporting and a 3-Year extended warranty.“

Which means, if I understand correctly, we could not program in the channels we locals use.

CHIRP is free and you can buy a programming cable. With that being said read my previous post about actually knowing the laws and following them.

““We find Mr VanVolkenburg’s misconduct particularly egregious because his unlicensed operation involved willful and malicious interference to the communications of the Brevard County Sheriff’s Department, which included threats against the officers, after being told (multiple times) to cease his interfering communications,” the FCC stated in the NAL.”

“As part of a Consent Decree released March 19, a Cocoa, Florida, radio amateur has agreed to give up his Advanced class Amateur Radio license. Terry L. Van Volkenburg, KC5RF, also has agreed to make a $1000 “voluntary donation” to the US Treasury, in installments, and waive all rights to contest the validity of the Consent Decree. In turn, the FCC is terminating a 2012 enforcement proceeding involving unlicensed transmissions that interfered with a sheriff’s department radio system. On March 1, 2013, the FCC found Van Volkenburg liable for a $25,000 forfeiture, which the Commission subsequently determined he would be unable to pay. The Enforcement Bureau also agreed not to institute a new proceeding on the basis of the one just concluded.”
