Property line dispute, anyone dealt with this?

    Hopefully we’ll get an update from OP. I had a similar issue but having a licensed survey helped prevent a lot of problems. I have bought and sold lots of properties but never used to have a survey - until recently when I put in a pool and had my yard surveyed and found my neighbors fence was about 1 ft on my back lot line.

    I’ve learned over the years good legal advice from a lawyer is worth it.

    3 things the OP needs to do:
    1. Get survey (looks like is in progress)
    2. Get legal representation
    3. Sell the house - take your profit and move someplace else! I could buy a gigantic lakefront mansion with a pimpin’ boat for what just plain average homes in CA are going for!

    I could not freaking believe [after reading the first page of this thread] that there were SEVEN MORE pages. Seeing I wasted some of my life reading this, here's my two cents:

    Get a LAWYER. Tundras.com is a horrible place to get property advice.:D

    To make #1 clear, here is why you need a lawyer: this is an adversarial dispute. These people are not your friends. They don't like you. Since they're from Berkeley, we can safely assume they are bat shit crazy ass-hats that think they are better than you. This will not end well.

    Property lines are on file with the court house [though these are generalized lines, not necessarily accurate]. Surveyors don't guess where property lines are located; they know where they are located.

    I guess this is why there is an old saying: good fences [those on the property line or slightly on your side of it] make good neighbors.

    I imagine he finally spoke with a real attorney as opposed to the Tundra forum attorneys and he said STFU on Social Media!!! Especially since your giving out tons of detail that could be used against you and at least one guy on this thread lives in the same subdivision...LOL

    Nah, just been traveling. Surveyors are here as we speak :)

    Spoke with a lawyer, he said his services weren't necessary until after the survey got done and if they fight it. He said it's a pretty cut and clear case.

    Read the first six pages or so, but not all, so I’m not sure if this has been said.

    Was a permit pulled when the garage was built? And is there a setback distance from property line? I know around me, you can’t build x feet from the property line, and if a permit was pulled, then it might be the proof you need.

    Or they might make you tear down your garage

    This argument is actually how i positioned the initial conversations when we first brought it up with them and they claimed it was theres. The houses were built together (whole subdivision was). My proof there was a problem is there was no way my garage would have been built so close to their property line when there is a 10' setback guideline.



    So far, talking with the surveyors, itl ooks like I'm gaining about 12ft in the front and losing about 1 ft in the back do to where my fence is......now the fun will begin once this is done and I tell them they gotta rip their driveway, landscaping, etc up (that's when i'll probably need legal council)

    Well this backfired. I gain about 8 ft up front, but they gain about 5 feet in the back. We found the original stakes in the back :duel:

    Man, the worst part is that you still have to live next to them. Awkward...

    When we bought property in the country, I put up a pipe fence. In all the corners, I encased the property rebar stakes along with the fence pipes in concrete.
